including attorney fees, arising out of orresulting from the negligort acts or omissions, <br />tortuous actions, or civil rights violations under State of Federal law ofthe County, its <br />ofiicers, agents and employees in connestion with the care, custody or confilrement of <br />any City inmate bY the CourtY. <br />C. The County and the City hereby waivq as to each other only, their immunity from suit <br />under industrial insurancq Title 51 RCW. The waiver of immunity was mutually <br />negotiated by the Parties hereto. <br />)ilV. fnsurance <br />. Without limiting the County's indemnification of City, and prior to conrmencement of this <br />agreement, the County shall obtain, provide and maintain during the term of this <br />agreement, policies or inzurance of the tlpe and amounts described below and in a form <br />satisfactory to the Crty or be oovered under similar limits by partictpation in a riskpool. <br />A. General Liabilify fnsurance. The County shall maintain oommercial general <br />liability insurance with at least as broad as Insurance Seryices Office form CG 00 <br />01, in an amount not less than $2,000,000 pet occurence, $4,000,000 general <br />aggregate, for bodily tnjury, personal injury, and properly darnage, including <br />without limitation, blanket confiactual liability. <br />B. Workerst Compensation Insurance. The County shall, at its own expense, <br />maintain Workers' Compensation Insuranoe (statutory Limits) and Employer's <br />Liability Insuranco (with limits of at least $2,000'000). <br />XV. Entire Contract <br />This agreement represents the entire understanding of the parties and supersedes any oral <br />representations that are inconsistent with or modiff its terms and conditions. <br />XW. Modification <br />firis agreement may be rnodified and amended only in writing and signed by the parties <br />hereto. <br />XVII. fndepgndent Contractor <br />kr providing services underthis Agreemen! Kittitas County is an independent conhactor <br />and neither it nor its officers, agents or employees axe employees of the City for any <br />putpose, including but not limited to, responsibility fot any federal or state tax, industrial <br />insurance or Sooial Security liability. Neither shall the provision of services under this <br />Agteement give rise to any claim of career seryice or civil service rights, which may <br />aocrue to an employee of the Cityunder any applicable law, rulo or regulation, <br />XVm.
