WOODS and KERRY K. WOODS <br />Grantee: Kittitas County <br />Abbreviated Legal Description: PT NW1/4 of SEI/4 Sec 27. T18N., Rl8E.. W.M. <br />Assessor's Tax Parcel ID No.: 861033 <br />The GRANTOR(s), JOHN N. WOODS AND KERRY K. WOODS, husband and wife, for and in <br />consideration of Mutual benefits, does hereby convey and warrants to Kittitas County a Temporary Construction <br />Easement, over, under and across the following described real estate, situated in Kittitas County, in the State of <br />Washington: <br />A Portion of the Existing Tax Parcel No's. 861033 (See Exhibit "A'o) <br />The undersigned hereby agrees to surrender possession ofthe lands and/or rights herein conveyed, granted, <br />transferred and/or released upon notice ofstart ofconstruction, given with at least 72-hour notice, This agreement to <br />surrender possession of the lands and/or rights herein conveyed, granted, transferred and/or released is further <br />conditioned on Kittitas County Public Works affirming it will not remove the flow restrictor plate on the Bender Road <br />Whiskey Creek crossing until completion of the Ellensburg Water Company siphon and the Whiskey Creek channel <br />improvements between the siphon and Bender Road are completed. Kittitas County Public Works further agrees to <br />leave the fill, culvert, and gate for an access ramp in place to maintain secondary access to the field, and to remove <br />the access road and regrade and reseed any disturbed areas to retum them to their original condition <br />It is also understood and agreed that the delivery of this easement is tendered and that the terms and <br />obligations hereof shall not become binding upon the Kittitas County, State of Washington unless and until accepted <br />and approved in writing by the County's Director of Public Works. <br />The covenants shall run the land and bind the Grantor and Grantor's heirs, successors and assigns <br />DATED tnis 14 aay 2024. <br />GRANTORS <br />N.
