1.7. "Existing Land Use Regulations" means the Kittitas County Code as of September 9. <br />2024. <br />1.8. "Landowner" shall refer to any owner of the Property, now or in the future as <br />contemplated by the Development Agreement. <br />1.9. "Property" means the property subject to this Development Agreement as legally <br />described in Exhibit A. <br />Section 2. The Project. The Project consists of the development and use of 445.42 acres in <br />Kittitas County, more particularly described below. The Project is preliminarily approved under <br />the Planned Unit Development (PUD) Ordinance (RZ-06-00027) and Plat (LP-06-00027). <br />2.1 Project Duration. The Project is anticipated to be phased over a thirty-year (30) period. <br />The Developer will have discretion to determine the order of phasing elements to <br />maximize work around the quarry buffer zone while allowing quarry operations to <br />continue to supply minerals and material to the development. <br />2.2 Supportive Facilities. The Project will include supportive facilities such as a community <br />center, athletic courts, a pool, solid waste handling facilities, roads, mail <br />collection/distribution facilities and a trail network. <br />2.3 Project Oversight, Operations and Management. The Developer shall be responsible <br />for all requirements set forth in this Development Agreement. <br />Section 3. Residential Development. The Property described in Exhibit A will be developed into <br />the Plat of Ranch on Swauk Creek, as approved by Ordinance 2006-59 &Resolution 2017-073. <br />The approved preliminary concept map, attached hereto as exhibit B, shows approximate location <br />and boundaries of lots established for the Ranch on Swauk Creek PUD by said ordinance and <br />resolution. Buildings, garages, shops and the like are allowed within the Ranch on Swauk Creek <br />PUD. <br />Section 4. Ranch on Swank Creek Owners Association. The Ranch on Swauk Creek Owners <br />Association will be created to govern residential areas, community facilities, stormwater facilities, <br />and rode improvements within residential nodes, and open space. The Group A Water System <br />Shall be owned operated and maintained by an entity established , owned and operated by a <br />designee of the applicant. Said designee shall establish operation procedures and rates as may be <br />approved by the Washington State Authorities having jurisdiction if an when required by state law. <br />Section 5. Recording. Parties and Successors Bound. As required by KCC 15A.11.050, this <br />Development Agreement shall be recorded with the real property documents of Kittitas County. <br />During the Development Period, the Development Agreement is binding on the parties, their <br />Development Agreement — Page 3 of 12 <br />
