Differences between the Contractor and the County, arising under and by virtue of the A$reement Documents shatt be brought to the attention of the County at the eartiest possibl,e time in order that such matters may be settted, or other appropriate action promptty taken. Except for such objections as are made of record in the manner hereinafter specified and within the time Limits stated, the records, orders, instructions, and decisions of the Kittitas County Commissioners shat[ be final' and conctusive. 22-2 Notice of PotentiaI Claims The Contractor shatt not be entitted to additionaI compensation which otherwise may be payable, or to extension of time for (1) any act or failure to act by the County, or (2) the happening of any event or occurrence, untess the Contractor has given the County a written Notice of Potential, Ctaim within ten (10) days of the commencement of the act, faiture, or event giving rise to the ctaim, and before finat payment by the County. The written Notice of PotentiaI Cl.aim shatl, set forth the reasons for which the Contractor be(ieves additionaI compensation or extension of time is due, the nature of the cost involved, and insofar as possibte, the amount of the potentiaI ctaim. Contractor shatl' keep ful,t and comptete daity records of the work performed, tabor and material used, and aLt costs and additionat time ctaimed to be additionat. 22.3. Detaited Ctaim The contractor shat[ not be entitted to ctaim any such additionat compensation, or extension of time, unless within thirty (30) days of the comptetion of the portion of the work from which the ctaim arose, and before final, payment by the County, the Contractor has given the County a detail'ed written statement of each element of cost or other compensation requested and of att etements of additional time required, and copies of any supporting documents evidencing the amount or extension of time ctaimed to be due. 23. Ownership of ltems Produced: At[ writings, programs, data, pubtic records or other materia[s prepared by the Contractor and/or its consuttants or sub-Contractors, in connection with the performance of this Agreement shaLt be the sote and absolute property of the County- 24. Confidentiality: The Contractor, its emptoyees, sub-Contractors, and their emptoyees shat[ maintain the confidentiatity of att information provided by the County or acquired by the Contractor in pedormance of this Agreement, except upon the prior written consent of the Kittitas County Prosecuting Attorney or an order entered by a court after having acquired jurisdiction over the County. Contractor shat[ immediatety give to the County notice of any judiciaI proceedings seeking disctosure of such information.
