FIRST AMENDMENT TO COMMERCIAL BUILDING SUBLEASE <br />This First Amendment to Commercial Building Sublease ("Amendment") is made and entered into this -(/ 1% <br />day of {2024, by and between AIRPORT HOLDINGS, LLC, a Washington Limited <br />Liability Company (hereinafter referred to as "Sublandlord") and KITTI'I'AS COUNTY, a political subdivision of the <br />State of Washington (hereinafter referred to as "Subtenant"). <br />A. WpREAS, Sublandlord and Subtenant entered into that certain Commercial Building Sublease <br />with an effective date of October 18,2022 (hereinafter "Sublease") for the Sublease of a portion of the Premises <br />located at 1111 Bowers Road, Eliensburg, Washington and more fully described in the Sublease; and <br />B. WHEREAS Sublandlord and Subtenant now desire to enter into this First Addendum to revise <br />certain terms of the Sublease as provided for below' <br />NOW, TIIEREFORE, for and in consideration of the mutual covenants and provisions contained herein and <br />the mutual covenants and provisions set forth in the Sublease, the receipt and sufficiency which is hereby <br />acknowledged, Sublandlord and Subtenant agree as follows: <br />1. Exhibit A was inadvertently omitted from the Sublease at the time of signing. Attached to this <br />Amendment as Exhibit A is the legal description of the ieased premises; <br />2. Exhibit B of the Sublease containing the Site Plan is attached hereto as Exhibit B. <br />3. The square footage of the leased space has changed and the current lease space is outlined on <br />Exhibit C attached hereto and incorporated herein by reference; <br />4. Paragraph 2.2 of the Sublease is hereby amended to read as follows: <br />..2.1 Lease Term. The Lease Term shall commence June l, 2024 and shall terminate at midnight of <br />the Termination Date (hereinafter referred to as the or "Lease Term"). A "Lease Year" shall <br />nean a calendar year commencing on the Rent Commencement Date'" <br />5. Paragraph 2.2.1 of the Sublease is hereby amended to read as follows: <br />"2.2.1 Lease Commencement Date. The Lease shall commence June 1, 2024 (hereinafter <br />refened to as the "Lease Commencement Date". The terms and conditions of this Lease shall apply on <br />and after the Lease Commencement Date." <br />6. Paragraph 3.2.1 ofthe Sublease is hereby amended to read as flollows: <br />"3.2.1 Shop Rent. The Shop Rent paid by Subtenant shall be $00.80 multiplied by the square <br />footageoftheshop,3,600squarefeet,foratotalmonthlyshoprentof$2,880.00. Thereafter,onJanuary <br />1 ofa lease year, colnmencing January 7,2024, shop rent shall increase by three (3Yo) percent per y€ar <br />during the initial term." <br />7. Paragraph 3.2.2 oftheSubleaseisherebyamendedto readas follows: <br />"3.2.2 Office Rent. The Ofl-rce Rent paid by Subtenant shall be $ 1 .54 muitiplied by the square <br />footage of the office area,273 square feet, for a total monthly office rent of $420.00.
