<br />Page | 41 <br /> <br /> <br />8.1 Washington Residential Landlord-Tenant Act <br />Lead/subgrantees must provide information on the Washington Residential Landlord Tenant Act (RCW <br />59.18) to households receiving rent assistance. <br />For more information on this law, visit Washington Law Help, housing page, tenant rights at <br />www.washingtonlawhelp.com. <br />8.2 Rental Agreements <br />Client files must contain one of the following types of agreements if rent assistance is paid on their <br />behalf: Intent to Rent, Lease, or Certification of Payment Obligation. <br /> <br />If the rent assistance paid is move-in costs (security deposits, first and last month’s rent) only, an Intent <br />to Rent form is allowable. If the rent assistance will exceed move-in costs to include on-going rent, a <br />lease or Certification of Payment Obligation is required. <br /> Intent to Rent <br /> At a minimum, an Intent to Rent form must contain the following: <br /> Name of tenant <br /> Name of landlord <br /> Address of rental property <br /> Rent rate <br /> Signature of landlord/date <br /> Lease <br />At a minimum, the lease or rental agreement between the lead/subgrantee and the landlord OR the <br />household and the landlord must contain the following: <br /> Name of tenant <br /> Name of landlord <br /> Address of rental property <br /> Occupancy (who gets to live at the rental) <br /> Term of agreement (lease start and end date) <br /> Rent rate and date due <br /> Deposits (if any and what for/term) <br /> Signature of tenant/date <br /> Signature of landlord/date <br /> Certification of Payment Obligation <br />A CHG Certification of Payment Obligation is required for rent subsidies paid to a friend or family <br />member who is not in the business of property management . This form must be kept in the client file. <br />8.3 Dispute Resolution Center Partnerships <br />Lead/subgrantees must coordinate with their local Dispute Resolution Centers (DRC) if one exists <br />within the service area.
