BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RE S OL UTI ON NO.2024-. <br />AUTHORIZING A DEVELOPMENT AGREEMENT BETWEEN DR HORTON AND <br />KITTITAS COUNTY PUBLIC WORKS FOR THE COMPLETION OF <br />PRELIMINARY PLAT CONDITIONS FOR THE BLACK HORSE AT WHISKEY <br />CREEK PLAT <br />WHEREAS: The Board of Kittitas County Commissioners approved a preliminary plat for <br />DR Horton's Black Horse at Whiskey Creek with Ordinance 2007-006; and <br />WHEREAS: A portion of the plat has been finalized pursuant to a phasing plan adopted <br />on February 16, 2021; and <br />WHEREAS: Kittitas County and DR Horton entered into a voluntary Mitigation Agreement <br />creating additional preliminary plat conditions on November 16, 2021; and <br />WHEREAS: Kittitas County and DR Horton desire further defining plat phasing timelines <br />incorporating additional voluntary mitigation measures associated with <br />preliminary plat, and <br />WHEREAS: Kittitas County Code 12.01.085 (previously KCC 12.89) encourages development <br />agreements with Public Works defining plat phases and actions necessary prior to <br />subsequent final plat phases, and <br />WHEREAS: The Kittitas County Board of County Commissioners did conduct the required <br />public hearing considering the development agreement on July 2, 2024, continued <br />July 16, 2024 and continued August 6, 2024. <br />NOW, THEREFORE BE IT RESOLVED: The Board of County Commissioners, after due <br />consideration and in the best interest of the public, does hereby approve the Public Works <br />Development Agreement with DR Horton defining preliminary plat conditions and associated <br />timelines of improvements supporting future final plat phases of Black Horse at Whiskey <br />Creek plat. <br />DATED this day of August 6, 2024, at Ellensburg, Washington. <br />Attest: <br />❑ Clerk of the Board- Julie Kjorsvik <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br />Brett Wachsmith, Chairman <br />Laura Osiadacz, Vice -Chairman <br />❑ Deputy Clerk of the Board- Mandy Buchholz <br />Cory Wright, Commissioner <br />
