Agreement Number 85-10-0004 <br />c. The Locat Govemment shall work with the Federal Government to locate alternative <br />housing solutions for the Federal prisoners' <br />d. The t-oial Government may not request rate or per-diem increases once the Local <br />Government has provided a terminatlon notice to the Federal Government and the <br />Federal Government has.acknowledged the recelpt of before mentloned notlce. <br />Where the Local Government has recelved a cooperatlve agreement through the POD'S <br />Cooperagve Agreement Program, the cooperatlve agreement termination and other applicable <br />provlsions shall: <br />a. be tncorporated into this agreernent; <br />b. survive ifter the explration of the cooperative agreement, and <br />c. supersede the terminatlon provlslons of this agreement. <br />(End of Provision) <br />7. Assignment and Outsourcing of Jall Operatlons (May 2O2l) <br />The overall management and operation of the Facility houslng Federal prlsoners shall not be <br />contracted out without the prior written notlflcation of the Federal Government. <br />(End of Provision) <br />8. Medical Services (MaY 2O2L) <br />The Local Government shall maintain written procedures that describe actions taken ln the event <br />of a prisoner's death, assault, or medlcal emergency to include notiflcatlon to the USMS. <br />The Local Government shall provide a medical and mental health screenlng upon admlsslon to the <br />Faclllty. The Local Government shall lnform prisonerc how to access health services. <br />The Loca! Government shatt nottfy the local IJSMS disffict office of any infedlous disease outbreak. <br />The Local Govemment shall provlde Federal prlsoners wlth the same level and range of care inside <br />the Facility as that provlded to state and local prisoners. The Local Government is financially <br />ieJponslOf! for all m6dicat care provided inside the Faclllty to Federal prisoners. This lncludes the <br />cosl of all medical, dentat, and mental health care as well as the cost of medical supplies, over- <br />ihe-counter medlcations and any prescription medlcatlons routinely stocked by the Faclllty. The <br />Facility is encouraged to purchase non-OTC medications for USMS prisoners through the USMS' <br />Nagonal Managed Care Contract (NMCC) Discount Pharmacy Prograrn. When posslble, generic <br />medications shoutd be prescribed. The cost of all of the above-referenced medical care ls covered <br />by the Federal per-diem rate. The Federal Governrnent will pay for the cost of specialized medlcal <br />servlces not routlnely provided withln the Facility, such as dialysis. <br />The Federal Government is flnancially responsible for all medlcal care provlded outside the Facillty <br />to Federal prlsonerc. The Federal Government must be bllled directly by outside medical care <br />providers pursuant to arrangements made by the Local Government for outside medical care.
