CONTRACTOR's operation or maintenance of the County Funded Network facilities under this <br />Agreement. Additionally, while the COUNTY will maintain legal ownership of the County <br />Owned Network, it may not, during the Term of this Agreement, sell, assign, or otherwise <br />transfer any of the County Funded Network without CONTRACTOR's prior written consent. <br />CONTRACTOR may condition any such consent on any such sale, assignment, or transfer being <br />explicitly made subject to and conditioned upon the continuation of the operating authority <br />granted by this Agreement. <br />Service Level Agreement for Performance of Fiber Optic Cable: <br />FIBER SYSTEM SPECIFICATIONS : <br />1.1 Optical Fiber Specifications: Optical fiber within the System will meet the <br />specifications set forth below and measurable by optical time domain <br />refl ectometer ("OTDR") : <br />Maximum attenuation <br />db/km Maximum attenuation <br />db/km Cladding diameter <br />Cutoff Wavelength <br />Zero dispersion wavelength <br />Maximum dispersion <br />1310nm (Al) <br />1550nm (A2) <br />125+-3 <br />1250 + - 100 <br />1310 + - 12 <br />(1285-133Onm) <br />.50 <br />.40 <br />nm <br />nm <br />nm <br />3.5 ps/nm km <br />Reference: EIA RS-455 test method <br />The CONTRACTOR shall test the fiber prior to the commencement of use for <br />compliance with the technical specifications set forth above. Upon completion of <br />testing, the COUNTY shall either send an acceptance notice to the <br />CONTRACTOR acknowledging the acceptance of the Leased Fibers as tested or <br />notifu the CONTRACTOR that the Leased Fibers do not comply with the <br />technical specifications. By sending an acceptance notice, the COUNTY <br />acknowledges that the fibers listed in the notice comply with the applicable <br />technical specifications. If the COUNTY fails to provide any notice within the <br />three (3) days provided, then the COTINTY shall be deemed to have accepted the <br />fibers. <br />In the event the result of any test performed in accordance with Section 3.2 herein <br />shows that the fiber(s) are not operating in accordance with the technical <br />specifications, the CONTRACTOR shall promptly take action that is reasonable <br />to bring the fiber(s) into compliance and shall notiSr the COUNTY when the <br />CONTRACTOR believes that the fiber(s) comply with the technical <br />specifications.
