COUNTY Final Approval of Design Services. CONTRACTOR shall coordinate the Design Services with the COLTNTY, and the COTINTY shall have final review and approval rights over any and all Design Services. Upon completion of the Design Services, the final COI-INTY System design, as approved by the COUNTY (the "Final Design"), shall be deemed part of this Agreement. "Reserved Dark Fiber" means COUNTY System Dark Fiber strands not made subject to this agreement that are reserved for use by the COUNTY for internal government use only. Reserved Dark Fiber shall be reserved and held for the COUNTY's sole and exclusive use and control and will consist of four (4) strands of Dark Fiber delivered to predetermined access points. 11. Safety. A) 1. ii CONTRACTOR shall take all reasonable precautions for the safety of, and shall provide all reasonable protection to prevent damage, injury, or loss to: all employees on the Work and all other persons who may be affected thereby; all the Work and all materials and equipment to be incorporated therein, whether in storage on or off-the site, under the care; custody or control of CONTRACTOR or any of its sub-contractors; and other property at the site or adjacent thereto, including trees, shrubs; lawns, walks, pavements, roadways, structures, and utilities not designated for removal, relocation or replacement in the course of construction. lll. B)CONTRACTOR shall give all notices and comply with all applicable laws, ordinances, rules, regulations, and lawful orders of any public authority bearing on the safety of persons or property or their protection from damage, injury or loss. c)CONTRACTOR shall erect and maintain, as required by existing conditions and progress of the Work, all reasonable safeguards for safety and protection, including posting danger signs and other warnings againsthazards, promulgating safety regulations, and notifuing owners and users of adjacent utilities. D)When the use or storage of hazardous materials or equipment is necessary for the execution of the Work, CONTRACTOR shall: (1) exercise the utmost care and shall carry on such activities under the supervision of properly qualified personnel; and (2) give the COUNTY notice, in writing, seven (7) days in advance of the planned activity of CONTRACTOR's intent to store and/ or use hazardous materials or equipment on the Project site. 12. Final Completion. CONTRACTOR shall noti$ as to final completion of the Work and the COUNTY shall accept the final completion of the Work for the respective phase only when all Work has been completed in accordance with the Contracts and CONTRACTOR has offered services to the public.
