ARTICLE II <br />DEFINITIONS <br />2'01 Deterttion. For purposes of this Agreernent, the terrrr "c.letention" shall mean that <br />period of time when a juve rrile is actually within the physical corrfines of the Chelarr <br />Oounty Juvenile Center or uncjer the direct supervision and control of a Chelan County <br />Juvenile Deparlment age nt, employee or officer. <br />2'02 Juvenile' As defined in RCW 13.40.Q20 (16), for purposes of this agreemer-rt, the <br />ternr "juvetrile" shall rnean any individual wlro is under lhe chronological age of 1B years <br />and who has not been previor,rsly transferreci to adult court pursuant to RCW 1:..40,110 <br />unless the indivicJual was convicted of a lesser charge or acquittec] of ilre charge for <br />which he or she was previously trarrsferred pursuant to RCW 13.40.110 or who is not <br />otherwise under adult courl jurisdiction <br />ARTICLE III <br />DUTIES OF TI.IE PARTIFS <br />3.01 Duties of Chelan County <br />Chelan County agrees to provide cJetention services to Kittitas Courrty on an <br />"as needed" basis. such services sherll be provided at the chelan county <br />Juverrile Deterrtion Center, Wenaltchee, Washington. <br />chelan county allrees to provide basic nredical care, inrrolving sick call and <br />routine follow-r-rp care to Kittitas County detainecl juveniles pursuant to the <br />curre nt agreement between Chelan county and its contract nrec.lical provicler <br />under tlre sanre ternrs and concJitions of said rnedical corrtract.
