FIRST AMENDMENT TO <br />MEMORANDUM OF AGREEMENT <br />BETWEEN MID-COLUMBIA FISHERIES ENHANCEMENT GROUP <br />AND <br />KITTITAS COUNTY PUBLIC WORKS DEPARTMENT <br />SUPPORTING LAND USE RESTORATION ACTIVITIES <br />THIS FIRST AMENDMENT TO MEMORANDUM OF AGREEMENT is made and entered <br />into as of the 6th day of February,2024, by and between Mid-Columbia Regional Fisheries <br />Enhancement Group, hereinafter referred to as "MID-COLUMBIA FISHERIES" or "MCF," and <br />Kittitas County, collectively referred to as the "PARTIES." <br />WHEREAS, Kittitas County and Mid-Columbia Fisheries entered into a Memorandum of <br />Agreement (MOA), effective April l, 2023 and authorized by Kittitas County Resolution No. <br />2023-056 to define MCF's and the County's respective roles, project contributions, and <br />specifuing funding for cooperative implementation actions for the Yakima River Comidor Plan <br />for habitat enhancement and flood risk management of the Yakima River, from the Jeffries <br />Levee to the Yakima River Canyon; and <br />WHEREAS, Mid-Columbia Fisheries and Kittitas County have secured additional grant funds to <br />implement the Scope of Work described in the MOA; and <br />WHEREAS, the Parties desire to amend the agreement to include these secured grant funds in <br />the financial plan; and <br />WHEREAS, all other elements of the MOA effective April l, 2023 remain unchanged; <br />NOW, THEREFORE, in consideration of the mutual covenants, promises, and agreements set <br />forth herein, it is agreed by and between Mid-Columbia Fisheries and Kittitas County to replace <br />Appendix B in the MOA with Amendment No. I to Appendix B Financial Plan, attached as <br />Exhibit l. <br />IN WITNESS WHEREOF, the parties have executed this Amendment as of the day and year first <br />above written. <br />By irh <br />Title: Chairman, Board of County Commissioners <br />By: Margaret Neuman <br />Title: Executive Director, <br />Mid-Columbia Fisheries <br />Date:January 30,2024Date: fob U, J0gt4
