BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION <br />NO. <br />AMENDING THE KITTITAS COUNTY PUBLIC WORKS DEPARTMENT FEE <br />SCHEDULE TO ADD WATER BUDGET NEUTRAL DETERMINATION <br />SERVICE AND SET THE FEE FOR THIS SERVICE <br />WHEREAS: Kittitas County Code Chapter 13.35.027 requires all new uses of <br />groundwater in the Yakima River Basin to demonstrate legal availability; <br />and <br />WHEREAS: Kittitas County Code Chapter 13.35.027 requires that new permit exempt <br />uses be mitigated through a water bank demonstrating legal availability <br />though a certificate of water budget neutrality; and <br />WHEREAS: The Department of Ecology is required by WAC 173-539A to make Water <br />Budget Neutral determinations within the Upper Kittitas County Rule area <br />only; and <br />WHEREAS: On November 6, 2023, Public Works staff presented a proposal to the <br />Yakima Basin Water Transfer Working Group for Kittitas County Public <br />Works to provide Water Budget Neutral Determination services outside <br />the Upper Kittitas County Rule area; and <br />WHEREAS: The Kittitas County Board of County Commissioners did conduct a public <br />hearing on January 16`s, 2024, receiving public testimony on the proposal <br />to amend the Public Works Fee schedule to add Water Budget Neutral <br />determination by Kittitas County Public Works and set a fee for this <br />service; and <br />WHEREAS: The Kittitas County Board of County Commissioners has considered and <br />incorporated relevant public comment into the Public Works Water <br />Budget Neutral Review fee proposal. <br />NOW, THEREFORE BE IT RESOLVED: The Board of County Commissioners, after <br />due consideration, does hereby adopt the proposed Kittitas County Public Works Fee <br />schedule, amended to add the Water Budget Neutral determination service fee. <br />
