Alder St. <br />Union Gap, WA 98903 <br />DOCUMENT TITLE: Quit Claim Deed — Water Right <br />GRANTOR: Kittitas County, a political subdivision of the State of <br />Washington <br />GRANTEE: Washington State Department of Ecology, State Trust <br />Water Rights Program <br />LEGAL DESCRIPTION: Instream Flow and Mitigation in the Yakima River <br />QUIT CLAIM DEED —WATER RIGHT <br />GRANTOR, KITTITAS COUNTY ("Grantor"), for valuable consideration, hereby <br />conveys and quit claims to the WASHINGTON STATE DEPARTMENT OF ECOLOGY, <br />STATE TRUST WATER RIGHTS PROGRAM ("Grantee") all of Grantor's right, title and <br />interest in and to the water right under Certificate No. S4-83598-J, described as follows: <br />0.662 cubic feet per second, from April 1 through October 31, 121.86 acre- <br />feet per year, instream in a primary reach beginning at the Yakima River at <br />River Mile 157.3, at a point approximately 300 feet north and 1,200 feet east <br />from the center of Section 29, being within the SW'/4NE'/4 of Section 29, T. <br />18N., R. 18 E.W.M. and continuing down to River Mile 153.8 within the <br />SE'/4SW'/4 of Section 3, T. 17N., R. 18 E.W.M., and 0.308 cubic feet per <br />second, 63.73 acre-feet per year, instream in a secondary reach beginning <br />at River Mile 153.8 on the Yakima River within the SE'/4SW'/4 of Section 3, <br />T. 17N., R. 18 E.W.M., and continuing downstream along the Yakima River <br />to the Yakima Canyon within Kittitas County at River Mile 127 within the <br />SE'/4NW'/4 of Section 33, T. 15N., R. 19 E.W.M. One third (1/3) of the <br />consumptive use of the water right will be dedicated for permanent instream <br />flow benefiting fish and wildlife. The water right will be permanently retained <br />within Kittitas County.
