2023 Docket Enabling Ordinance December 19, 2023 <br />Page 188 <br /> <br /> <br />12.14.01.010 Ownership responsibility. <br />12.14.01.020 Acquiring permits. <br />12.14.01.030 Cost of restoration and repair. <br />12.14.01.040 Adoption. <br /> <br />12.14.01.010 Ownership responsibility. <br />The entity benefited by the construction, whether it be a private party, a public utility, a <br />municipal entity or a service district, is solely responsible for the construction, maintenance, <br />restoration, repair, installation and ownership of any of their facilities located within the <br />county road rights-of-way. Agreements between any vendor of services and their vendees <br />should reflect this understanding. (Ord. 94-18 (part), 1994; Ord. 92-30 (part), 1992. Formerly <br />12.20.010). <br />12.14.01.020 Acquiring permits. <br />The public utility, municipal entity or service district providing requested service is solely <br />responsible for acquiring all the necessary permits and approvals prior to locating facilities <br />within the county rights-of-way and compliance with all the terms and conditions stipulated <br />in the permit. No permits to install facilities in county right-of-way will be issued to private <br />individuals or legal persons or entities for services that are provided by public utilities, <br />municipal entities or service districts. (Ord. 94-18 (part), 1994; Ord. 92-30 (part), 1992. <br />Formerly 12.20.020). <br />12.14.01.030 Cost of restoration and repair. <br />The cost of restoration and repair will be the sole responsibility of the entity benefited by the <br />construction whether it be a public utility, a municipal entity or a service district providing the <br />service. Formerly 12.20.030). <br />12.14.01.040 Adoption. <br />Chapter 136-40 WAC and any subsequent amendments thereto is hereby adopted and the provisions contained therein shall be applicable to all franchises and permits issued pursuant to <br />Chapters 36.55, 80.32 and 80.36 RCW, to all public and private utilities including but not limited to electric power, telephone, telegraph, water, gas, oil, petroleum products, steam, chemicals, sewage, drainage, irrigation and similar lines that are to be located, adjusted or relocated with the rights-of-way of county roads. <br />Nothing in this chapter shall be construed as limiting the rights of Kittitas County to impose <br />restrictions or requirements in addition to and/or deviations from those stated in Chapter 136-40 WAC in a franchise or permit where Kittitas County deems it advisable to do so.
