2023 Docket Enabling Ordinance December 19, 2023 <br />Page 166 <br /> <br /> <br /> In addition to any penalties under 12.01.060, any person, firm or corporation violating the <br />provisions of this chapter shall be responsible in damages to Kittitas County for any reasonable amount <br />necessary to repair, replace, resurface or to otherwise restore such county road as may be affected, to <br />the condition in which said road was prior to violating acts. <br /> 12.09.01.040 Provisions Supplemental <br /> The provisions of this chapter shall be cumulative and nonexclusive and shall not affect any <br />other remedy of law. <br /> 12.09.01.050 Severability <br /> If any provision of this Chapter or its application to any person or circumstances is held invalid, <br />the remainder of the Chapter or the application of the Chapter to other persons or circumstances shall <br />not be affected. <br /> <br />12.10 Vacation of County Road <br /> <br /> Article I. General Information <br /> <br />12.10.01.010 Vacation. <br />Vacation of right-of-way is controlled by Chapter 36.87 RCW and the provisions of this <br />chapter. Road vacation procedures may be initiated either by board resolution or freeholder <br />petition. (Ord. 94-32 (part), 1994; Ord. 93-17 (part), 1993.
