All applicable WSDOT Standard Plans <br />Driveways shall include culverts as required by the driveway approach section of these <br />standards. <br />12.04.05.090 Fish Passage. <br />All culverts associated with fish bearing streams in Kittitas County shall be designed for fish <br />passage standards in accordance with the Washington State Department of Ecology, and <br />Washington Department of Fish and Wildlife Water Crossing Design Guidelines. <br /> <br />Fish passage facilities meeting the criteria of a bridge or major drainage structure shall be <br />designed in accordance with KCC 12.04.06. <br /> <br />12.04.05.100 Stormwater System Operation & Maintenance. <br />All stormwater drainage systems within current or future County right-of-way shall be designed <br />and constructed in accordance with these standards, for maintenance by the County. <br />All stormwater drainage systems constructed for the purpose of storage, conveyance, collection <br />or treatment of stormwater generated on privately owned properties shall be designed and <br />constructed in accordance with these standards, and shall be maintained at the expense of and <br />by the property owner, developer, homeowner’s association, or other responsible entity. This <br />responsibility and the provision for maintenance shall be clearly stated on subdivision and short <br />plat plans and/or drainage improvement plans. Prior to final approval of any plan of <br />development or other development for which a permit is required under this article, the <br />property owner shall execute a maintenance agreement acceptable to the County Engineer that <br />specifies maintenance required by the property owner, provides access to the County for <br />inspection, and provides access to the County to perform maintenance activities in the event <br />that the property owner does not perform required maintenance. The agreement shall be <br />recorded in the office of the county auditor, a note placed on the recorded plat with the <br />auditor’s file number, and shall run with the land. <br />12.04.05.110 Inspection and Enforcement. <br />A. Inspection Authority. Whenever implementing the provisions of this article or <br />whenever there is cause to believe that a violation of this article has been or is being <br />committed, the County Engineer or designee is authorized to inspect during regular <br />working hours and at other reasonable times all stormwater drainage systems within <br />Kittitas County to determine compliance with the provisions of this article.
