Workers'compensation coverage shall be provided for <br />all employees of Grantec and employees of any contractors, sub-contractors or <br />other permittees, Except as prohibited by law, Grantee(s) waives all rights of <br />subrogation against Sutc for recovery of damages to the extent they ari <br />covered by workers compensation, cmployer's liability, cornmercial geneml <br />liability or mmmcrcial umbrella liability insurance. <br />All insurance must be purchased on an occurrence basis and should bc issued by companies <br />admitted to do business within the State of Washington and have a rating of A- or betier in thc <br />most recently published edition of Best's Reports. Any exccption shall be reviewed and <br />approved in advance by the Risk Manager for the Department ofNatural Resources. If an <br />insurer is not admitted, all insurance policies and procedures for issuing the insurance policies <br />must cornply with Chapter 48. I 5 RCW and Chapter 294- 15 WAC. <br />The state of washington, Department ofNatural Rcsources, its eleoted and appointed <br />gS?Ftt' agcnts and employees shall be named as an additional insured on aligeneral <br />liability, excess, and umbrella insurance policies. <br />Before using any said rights granted herein, Grantee shall furnish State with a certificate(s) of <br />inlyra.nc9, executed by a duly authorized represcntative ofeach insurer, showing comptiance <br />with the insurance requirernents specified above. Certificate(s) must reference State's <br />- <br />easement number. <br />State shall be provided written notice before cansellation or non-renewal of any insurance <br />referrcd t? !gr.rin: as prescribed in statute (chapter 48.18 Rcw or chaptcr 4g.i5 Rcw). <br />Grantee shall include all contractors, sub-contractors and other permittees (with the exclusion <br />of the Public Permittees) as insureds under all required insurance poticies, or shall fi:rnish <br />separste certificates of insurancc and endorsements for each, Contractorg sub-contractors and <br />othcr pcrmiftees (with the exclusion of the Public Permitteos) must comply with all insurance <br />requirements stated herein. Failure ofcontractors, sub-contractors and oihcr permittees (with <br />the exclusion ofthe Public Permiuecs) to comply with insurance requirements does notlimit <br />Grantee's liability or responsibility. <br />All insurance provided in oompliance with this Easement shall bc primary as to any other <br />insurance or self-insurance programs sforded to or maintained by State. <br />-Grantee <br />waives all <br />rights against state for re!9very ofdamages to the extent these damages are covcred by <br />general liability or umbrella insurance maintained pursuant to this Easement. <br />By rcquiring insurancs hercin, Statc does nst rsprcsent that coverage and limits will be <br />adeguate to protect Grantee, and such coverage and limits shall nof limit Grantce,s liability <br />under the indemnities and reimbursemcnts granted to state in this Easemcnt, <br />If Grantee is self-insured, evidence of its status as a self-insured entity shall be provided to <br />4of17 EasementNo. 5G103249
