BOARD OF COUNTY COMMISSIONERS <br />COUNTY OF KITTITAS <br />STATE OF WASHINGTON <br />RESOLUTION NO. 2023 - <br />SELECTING BAER TESTING AS PUBLIC WORKS ON -CALL TASK ORDER <br />CONSULTANTS FOR UP TO A THREE-YEAR PERIOD OF SERVICE AND <br />AUTHORIZE THE COUNTY ENGINEER SIGNATURE ON SAID CONTRACT <br />WHEREAS: The Department of Public Works (PW) prepared a solicitation for engineering and <br />professional services including material testing consistent with state law and <br />county code in September 2022; and <br />WHEREAS: The Department of Public Works did also solicit for material testing for a specific <br />road construction project consistent with state law and county code in July 2023; <br />and <br />WHEREAS: The Department of Public Works did not receive any submittals for material <br />testing; and <br />WHEREAS: Material testing is an integral part of the construction process to ensure materials <br />meet construction specifications; and <br />WHEREAS: Competitive bidding requirements may be waived per RCW 39.04.280 due to <br />market conditions; <br />NOW, THEREFORE BE IT RESOLVED that the Board of County Commissioners, in the <br />best interest of the public, does hereby waive competitive bidding requirements and direct Public <br />Works to enter a standard professional contract with Baer Testing & Engineering, Inc. for <br />materials testing; <br />BE IT FURTHER RESOLVED the County Engineer is directed to sign said contracts on <br />behalf of the Board of County Commissioners. <br />DATED this I' day of August 2023, at Ellensburg, Washington. <br />BOARD OF COUNTY COMMISSIONERS <br />KITTITAS COUNTY, WASHINGTON <br />Cory Wright, Chairman <br />Attest: <br />❑ Clerk of the Board- Julie Kjorsvik <br />Brett Wachsmith, Vice -Chairman <br />❑ Deputy Clerk of the Board- Mandy Buchholz <br />Laura Osiadacz, Commissioner <br />
