6. Proposed access design. <br />B. The Department will evaluate access permit applications upon receiving the permit fee. <br />The Department will make every effort to evaluate the permit within 15 days. <br />C. The Department will work cooperatively with applicants when determining requirements <br />on access requests. Through this cooperative evaluation process, the Department may <br />determine a variation from the access design standards is necessary due to site <br />limitations or other existing conditions and has the authority to make that decision. <br />However, if the applicant disagrees with the Department's requirements on an access <br />request, the applicant will be required to request a variance to the standards according <br />to KCC 12.01.130. <br />D. Prior to issuing a denial on an access permit request, the Department shall attempt to <br />resolve the reasons for the denial with the applicant. <br />E. Any appeals of a denied access permit shall be resolved through the Administrative <br />Decisions Appeals process according to KCC 15A.07. <br />(Ord. 2015-010. 2015) <br />12.05.050 Construction of Access. <br />A. The issued access permit will be provided to the permittee along with the requirements <br />for construction. The permittee will have the amount of time defined by the <br />accompanying building permit from the date of issuance, as shown on the permit, to <br />complete construction of the access and request inspection by the Department. In the <br />absence of a building permit the permittee will have 12 months from the date of <br />issuance to complete construction and request inspection by the Department. <br />B. The construction of the access suitable to Public Works inspection staff must complete <br />prior to issuance of final occupancy. <br />C. The expected dates of construction and use of the access shall be included on the <br />request for an access. The permittee shall notify the Department at least 48 hours prior <br />to any construction in County right-of-way. <br />D. The Department shall inspect the access upon completion of construction to ensure that <br />all terms and conditions of the permit are met. The Department may request to inspect <br />the access during construction. <br />E. The construction of the access and its appurtenances as required by the terms and <br />conditions of the permit shall be completed at the expense of the permittee. <br />It is the responsibility of the permittee to complete the construction of the access <br />according to the terms and conditions of the permit. The Department may order a halt <br />to any unauthorized construction or use. <br />
