bicycling, equestrian and pedestrian public safety needs are met. Considerations include safety, <br />convenience, pleasant appearance, proper drainage and economical maintenance. The County's <br />permitting and licensing activities require the adoption of specific, identifiable standards to guide <br />private individuals and entities in the administrative process of securing the necessary County <br />approval. The County must have flexibility to carry out its general duty to provide streets, roads and <br />highways for the diverse and changing needs of the traveling public. Accordingly, these standards <br />are not intended to represent the legal standard by which the County's duty to the traveling public is <br />measured. <br />The Standards cannot provide for all situations. They are intended to assist but not substitute for <br />competent work by design professionals. It is expected that land surveyors, engineers and architects <br />will bring to each project the best of skills from their respective disciplines. These Standards are also <br />not intended to limit unreasonably any innovative or creative effort, which could result in better <br />quality, better cost savings, or both. Any proposed departure from the Standards will be judged on <br />the likelihood that such variance will produce a compensating or comparable result. <br />In order to remain current with technological changes and public needs, these standards are subject <br />to revisions. This manual is printed in a format that can be easily updated. This edition will be current <br />at the time of issuance; however, it is incumbent for the holder to keep the manual current with <br />revisions to the standards. (Ord. 2015-010 2015) <br />12.01.020 Scope. <br />This title is not a textbook or a substitute for engineering knowledge, experience, or judgment. It is <br />intended to aid in deciding those factors needed to intelligently plan, design, construct, upgrade, <br />and maintain public and private roads in the County. <br />The requirements contained in this title apply to all new construction, improvements to existing <br />roads, or other work done on, over, or under any public or private roads within the County. <br />Requirements of the title shall be enforced in the same manner as other Kittitas County Codes (KCC), <br />including injunctions resulting in work stoppage and noncompliance suits for damages to County <br />roads or rights -of -way. (Ord. 2015-010, 2015) <br />12.01.030 Applicability. <br />This title shall apply to all land within the unincorporated areas of the County except where <br />superseded by other governmental jurisdiction. <br />These Standards shall apply to all newly constructed public and private roads and right-of-way <br />facilities required by land use development approvals within Kittitas County. In the event of conflict <br />with the current subdivision and zoning codes, KCC Titles 16 and 17 these Standards shall control. <br />These Standards do not apply to State or Federal roads. If roads are required to be built to public <br />standards and are inspected and certified as such, the County may accept these roads onto the <br />County Road system for continued maintenance, subject to limitations as addressed in <br />12.01.070. <br />The Standards may apply to modifications of roadway features of existing facilities which are within <br />the scope of reconstruction or capital improvement projects when so required by Kittitas County or <br />to the extent they are expressly referred to in project plans and specifications.
