A. LESSEE's obligation to indemnift LESSOR as set forth in this Section shall be <br />limited to the extent of LESSEE's negligence, and that of LESSEE's Associates, <br />including LESSEE's proportional share of costs, attorneys' fees, and expenses <br />incurred in connection with any claim, action or proceeding brought with respect <br />to such injury or damage; and <br />B. LESSOR's obligation to indemniff LESSEE as set forth in this Section shall be <br />limited to the extent of LESSOR's negligence, and that of LESSOR's <br />Associates, including LESSOR's proportional share of costs, attorneys' fees, and <br />expenses incurred in connection with any claim, action or proceeding brought <br />with respect to such injury or damage. <br />THE LESSOR AND LESSEE SPECIFICALLY AGREE THAT THE PROVISIONS OF THIS <br />SECTION 8 ALSO APPLY TO ANY CLAIM OF INJURY OR DAMAGE TO THE PERgON,S <br />OR PROPERTY OF THE LESSORAND LESSEE'S RESPECTIVE EMPLOYEES, AND <br />LESSORAND LESSEE, AND EACH OF THEM, SEPARATELY ACKNOWLEDGES AND <br />AGREES THAT, AS TO SUCH CLAIMS, EACH AS TO THE OTHER DOES HEREBY <br />WAIVE ANY RIGHT OF IMMUNITY WHICH THEY MAY HAVE UNDER INDUSTRAL <br />INSURANCE (TITLE 5 ] RCW AS AMENDED AND UNDER ANY SUBSTITUTE OR <br />REPLACEMENT STATUTE), THIS WAIVERAND AGREEMENT WAS SPECIFICALLY <br />NEGOTATED BY LESSORAND LESSEE AND IS SOLELY FORTHE BENEFIT OF <br />LESSOR AND LESSEE AND THEIRSUCCESSOR,S AND ASSIGNS AND IS NOT <br />INTENDED AS A WAIVER OF EITHER'S MGHTS OF IMMUNITY UNDER SAID <br />INDUSTRAL INSURANCE FORANY OTHER PURPOSE. <br />8.5Insurance: <br />The LESSEE shall obtain and maintain in force during the term of this agreement a liability <br />insurance policy, which provides protection for bodily injury (including death) and property <br />damage. Said insurance shall provide coverage by the LESSEE to any employees or <br />permittees of the LESSEE and shall name the LESSOR as coinsured. <br />All policies (except any policies required for workers' compensation or errors and <br />omissions) and the certificates evidencing coverage shall name Lessor and Lessor's <br />Associates as additional insureds. Lessee shall provide for a renewal of all insurance <br />coverage on a timely basis to prevent any lapse in coverage. All certifications of meeting <br />the insurance requirements of this lease are attached hereto as Exhibit F and incorporated <br />herein by this reference. <br />The LESSEE shall provide the LESSOR with a copy of said insurance policy <br />LESSEBil- <br />Vv\ilA <br />13 LESSOR
