BOARD OF COUNTY COMMISSII COUNTY OF KITTITAS STATE OF WASHINGTON RESOLUTION NO. 2023 - RATIFYING THE CHAIR OF COUNTY COMMISSIONERS SIGNATURE ON THE WATER RIGHTS PURCHASE AND SALE AGREEMENT FOR WATER RIGHT CERTIFICATE NO. S4- 84269 -J AND AUTHORIZING CHAIR SIGNATURE ON CLOSING DOCUMENTS WHEREAS: Kittitas County maintains a water banking program accepted by the Washington State Department of Ecology (WDOE) as administered by the Public Works Department; and WHEREAS: On March 13, 2023, the Kittitas County Board of Commissioners entered into a Purchase and Sale Agreement with David W. Adams, LeAnn T. Adams William S. Craig, and Constance M. Craig to purchase the consumptive and non -consumptive portions of the Water Right with a priority date of June 30, 1871, and assigned Certificate No. S4 -84269- J; and WHEREAS: The Purchase and Sale Agreement identifies several contingencies that need to be satisfied to close the transaction; and WHEREAS: One identified contingency is for the Kittitas County Board of Commissioners to pass a resolution in the ordinary course of its business ratifying the Purchase and Sale Agreement. NOW THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Kittitas County, Washington, in the best interest of the public, does hereby ratify the Chair signature on the water rights purchase and sale agreement for Water Right Certificate No. S4 -84269-J. BE IT FURTHER RESOLVED, once all contingencies in the Purchase and Sale Agreement have been met, the Chair of the Kittitas County Board of Commissioners is authorized to execute any further documents, on behalf of Kittitas County, necessary to close the transaction.
