C. it is a business in good standing and is financially solvent, able to pay its <br />debts as they mature and possessed of sufficient working capital to complete and perform <br />its obligations under this Contract; and <br />D. it acknowledges that the Owner has relied on its experience and technical <br />management capabilities to identify, evaluate and recommend the FIMs that are the <br />subject of and to be installed pursuant to this Contract, and it is qualified and possessed <br />of the technical expertise to perform the audit and install the FIMs to the best <br />professional standards as accepted within the industry. <br />SECTION 18. PROPERTY/CASUALTY/INSURANCE: INDEMNIFICATION <br />Section 18.1. General. ESCO shall maintain through the term of this Contract the <br />insurance coverage, outlined below, and all such other insurance as required by applicable law. <br />Within ten (10) days of execution of this Contract, ESCO shall provide evidence of coverage to <br />the Owner and shall update such evidence on an annual basis via a Certificate of Insurance or <br />endorsement, as required by the Owner. <br />Section 18.2. Workers' Compensation / Employers Liability_. Workers' Compensation/ <br />Employers Liability for states in which ESCO is not a qualified self-insured. Limits as follows: <br />A. Workers' Compensation — Statutory <br />B. Employers Liability <br />Bodily Injury by accident $1,000,000 each accident <br />Bodily Injury by disease $1,000,000 each employee <br />Bodily Injury by disease $1,000,000 policy limit <br />Section 18.3. Commercial General Liability. Commercial General Liability insurance <br />with limits of: <br />* $1,000,000 per occurrence for Bodily Injury and Property Damage <br />* $2,000,000 General Aggregate — other than Products/Completed <br />Operations <br />* $1,000,000 Products/Completed Operations Aggregate <br />* $1,000,000 Personal & Advertising Injury <br />Coverage is to be written on an Occurrence form. Coverage is to be issued as on ISO form <br />CG 2010 (10/01), without endorsements that limit the policy terms with respect to: (i) the definition <br />of an Insured Contract, (ii) provisions for severability of interest, (iii) explosion, collapse, <br />underground hazard. <br />Section 18.4. Auto Liability. Auto Liability insurance for owned, hired and non -owned <br />vehicles with limits of $1,000,000 per accident. Coverage is to be written on an Occurrence form. <br />Section 18.5.
