Fredrickson <br />RECOMMENDATION: <br />Direct staff to provide notification of gate encroaching in the right-of-way. <br />BRIEFING SUMMARY: <br />• Naneum Road Right -of -Way was identified in County Road project 8-74 plans. <br />• Filed survey V:21, P:128 recentered the right-of-way on the as -built location. <br />• Original right-of-way included a turn -around at the end of the road. <br />The turnaround at the end of Naneum Road has been gated by private owners. <br />BACKGROUND: <br />Public Works has been made aware of a substantial gate installed at the north end of <br />Naneum Road, at an area historically used as a snowplow turnaround. This turnaround <br />area also appears to provide the access to parcel no. 298334. The installed gate limits <br />access to the historic turnaround area. The gate is not across the mainline of Naneum <br />Road, rather it is located at the mouth of the cul-de-sac leading to the turnaround. County <br />survey research of the right-of-way found the following historical documents. <br />In 1974 County Road Project 8-74 plans identify the turnaround as part of the right-of- <br />way. In 1995 a private surveyor noted the road as constructed did not fall in the area <br />identified on the plans. PW at that time provided a letter to the surveyor providing <br />direction to establish the right-of-way around the center of the road. In 1996 the private <br />surveyor filed survey Volume:21, Page: 198 identifying the revised right-of-way position <br />and noting the discrepancy to the 1974 document. In the 1996 survey the turnaround area <br />is absent. There is nothing readily found in the road file related to a county approval or <br />review of the work by the private surveyor. <br />DISCUSSION: <br />Road vacation of public right-of-way is controlled by RCW Chapter 36.87 and the <br />provisions of Kittitas County Code 12.22. The road vacation procedure may be initiated <br />either by the Board by resolution or by owner petition. No documentation has been <br />identified for the road vacation of the turnaround at the north end of Naneurn Road.
