ArticleXXXIII-ReportingofMattersRelatedtoRecipientIntegrityandPerformanceGeneralReportingRequirements:ifthetotalvalueofanycurrentlyactivegrants,cooperativeagreements,andprocurementcontractsfromallfederalawardingagenciesexceeds$10,000,000foranyperiodoftimeduringtheperiodofperformanceofthisfederalaward,thentherecipientsmustcomplywththerequirementssetforthinthegovernment-wideAwardTermandConditionforRecipientIntegrityandPerformanceMatterslocatedat2C.F.R.Pali200,AppendixXII,thefulltextofwhichisincorporatedherebyreferenceintheawardtermsandconditions.ArticleXXXIV-ReportingSubawardsandExecutiveCompensationReportingoffirsttiersubawards:Recipientsarerequiredtocomplywiththerequirementssetfodhinthegovernment-wideawardtermonReportingSubawardsandExecutiveCompensationlocatedat2C.F.R.Part170,AppendixA,thefulltextofwhichisincorporatedherebyreferenceintheawardtermsandconditions.ArticleXXXV-RequiredUseofAmericanIron,Steel,ManufacturedProducts,andConstructionMaterialsRecipientsandsubrecipientsmustcompwiththeBuidAmerica,BuyAmericaAct(BABAA),whichwasenactedaspartoftheInfrastructureInvestmentandJobsActSections70901-70927,Pub.L.No.117-58(2021),andExecutiveOrder14005,EnsuringtheFutureisMadeinAllofAmericabyAl-ofAmerica'sWorkers.SeealsoOfficeofManagementandBudget(OMS),MemorandumM-22-11,InitialimplementationGuidanceonApplicationofBuyAmericaPreferenceinFedera:FinancialAssistanceProgramsforInfrastructure.Recipientsandsubrecipientsoffederalfinancialassistanceprogramsforinfrastructureareherebynotifiedthatnoneofthefundsprovidedunderthisawardmaybeusedforaprojectforinfrastructureunless:(1)allironandsteeusedintheprojectareproducedintheUnitedStates--thismeansallmanufacturingprocessesfromtheinitialmeltingstagethroughtheapplicatonofcoatings,occurredintheUnitedStates;(2)allmanufacturedproductsusedintheprojectareproducedintheUnitedStates--thismeansthemanufacturedproductwasmanufacturedintheUnitedStates;andthecostofthecomponentsofthemanufacturedproductthataremined,produced,ormanufacturedintheUnitedStatesisgreaterthan55percentofthetotalcostofallcomponentsofthemanufacturedproduct.unlessanotherstandardfordeterminingtheminimumamountofdomesticcontentofthemanufacturedproducthasbeenestablishedunderapplicablelaworregulation;and(3)allconstructionmaterialsaremanufacturedintheUnitedStates--thismeansthatallmanufacturingprocessesfortheconstructionmaterialoccurredintheUnitedStates.TheBuyAmericapreferenceonlyappliestoarticles,materials,andsuppliesthatareconsumedin,incorporatedinto,oraffixedtoaninfrastructureproject.Assuch,tdoesnotapplytotools,equipment,andsupplies,suchastemporaryscaffolding,broughttotheconstructionsiteandremovedatorbeforethecompletionoftheinfrastructureprojectNordoesaBuyAmericapreferenceapplytoequipmentandfurnishings,suchasmovablechairs,desks,andportablecomputerequipment,thatareusedatorwithinthefinshedinfrastructureproject.butarenotanintegralpartofthestructureorpermanentlyaffi×edtotheinfrastructureprojectWaiversWhennecessary,recpientsmayapplyfor,andtheagencymaygrant,awaiverfromtheserequirements.(a)Whenthefederalagencyhasmadeadeterminationthatoneofthefollowingexceptionsapplies,theawardingofficialmaywaivetheapplicationofthedomesticcontentprocurementpreferenceinanycaseinwhichtheagencydeterminesthat:(1)applyingthedomesticcontentprocurementpreferencewouldbeinconsistentwiththepublicinterest;(2)thetypesofiron,steel,manufacturedproducts,orconstructionmaterialsarenotproducedintheUnitedStatesinsufficientandreasonablyavailablequantitiesorofasatisfactoryquality,or(3)theinclusionofiron,steel,manufacturedproducts,orconstructionmaterialsproducedintheUnitedStateswillincreasethecostoftheoverallprojectbymorethan25percent.Arequesttowaivetheapplicationofthedomesticcontentprocurementpreferencemustbeinwriting.Theagencywillprovideinstructionsontheformat,contents,andsupportingmaterialsrequiredforanywaiverrequestWaiverrequestsaresubjecttopubliccommentperiodsofnolessthan15daysandmustbereviewedbytheOMBMadeinAmericaOffice.DHS-FEMA-HSGP-SHSP-FY22Page32of44KittitasCounty,E23-116
