TheFiscalYear(FY)2022DHSStandardTermsandConditionsapplytoallnewfederalfinancialassistanceawardsfundedinFY2022ThesetermsandconditionsflowdowntosubrecipientsunlessanawardtermorconditionspecificallyindicatesotherwiseTheUnitedStateshastherighttoseekjudicialenforcementoftheseobligations.Alllegislationanddigitalresourcesarereferencedwithnodigitallinks.TheFY2022DHSStandardTermsandConditionswillbehousedondhsgovatwww.dhs.gov/publication/fy15-dhs-standard-terms-and-conditionsArticleIll-Assurances,AdministrativeRequirements,CostPrinciples,RepresentationsandCertificationsI.DHSfinancialassistancerecipientsmustcompleteeithertheOfficeofManagementandBudget(OMB)StandardForm424BAssurances-Non-ConstructionPrograms,orOMBStandardForm424DAssurances-ConstructionPrograms,asapplicableCertainassurancesinthesedocumentsmaynotbeapplcabletoyourprogram.andtheDHSfiriancialassstanceoffice(DHSFAO)mayrequireapplicantstocertifyaddtionalassurancesApplicantsarerequiredtofillouttheassurancesasinstructedbytheawardingagency.IlDHSfinancialassistancerecipientsarerequiredtofollowtheapp1cableprovisionsoftheUniformAdministrativeRequirements,CostPrinciples,andAuditRequirementsforFederalAwardslocatedatTitle2,CodeofFederalRegulations(CFR.)Part200andadoptedbyDHSat2C.F.R.Part3002.III.Byacceptingthisagreement,recipients,andtheire×ecutives,asdefinedin2C.F.R.section170.315,certifythattheirpoliciesareinaccordancewithOMB'sguidancelocatedat2C.F.R.Part200.allapplicablefederallaws,andrelevantExecutiveguidance.ArticleIV-GeneralAcknowledgementsandAssurancesAllrecipients,subrecipients,successors,transferees,andassigneesmustacknowledgeandagreetocomplywithapplicableprovisionsgoverningDHSaccesstorecords,accounts,documents,information,facilities,andstaff.l.RecipientsmustcooperatewithanyDHScompliancereviewsorcomplianceinvestigationsconductedbyDHS.II.RecipientsmustgiveDHSaccesstoexamineandcopyrecords.accounts,andotherdocumentsandsourcesofinformationrelatedtothefederalfinancialassistanceawardandpermitaccesstofacilitiesorpersonnel.III.Recipientsmustsubmittimely,complete,andaccuratereportstotheappropriateDHSofficialsandmaintainappropriatebackupdocumentationtosupportthereports.IV.Recipientsmustcomplywithallotherspecialreporting,datacollection,andevaluationrequirements,asprescribedbylaw,ordetailedinprogramguidance.V.Recipients(asdefinedin2C.F.R.Part200andincludingrecipientsactingaspass-throughentities)offederalfinancialassistancefromDHSoroneofitsawardingcomponentagenciesmustcompletetheDHSCivilRightsEvaluationToolwithinthirty(30)daysofreceiptoftheNoticeofAwardforthefirstawardunderwhichthistermapplies.RecipientsofmultipleawardsofDHSfinancialassistanceshouldonlysubmitonecompletedtoolfortheirorganization,notperaward.Aftertheinitialsubmission,recipientsarerequiredtocompletethetoolonceeverytwo(2)yearsiftheyhaveanactiveaward,noteverytimeanawardismade.Recipientsshouldsubmitthecompletedtool,mciudingsupportingmaterials,toCivilRightsEvaluation@hq.dhs.gov.ThistoolclarifiesthecivilrightsobligationsandrelatedreportingrequirementscontainedintheDHSStandardTermsandConditions.SubrecipientsarenotrequiredtocompleteandsubmitthistooltoDHS.Theevaluationtoolcanbefoundathttps://www.dhs.gov/publication/dhs-civil-rights-evaluation-tool.TheDHSOfficeforCivilRightsandCivilübertieswillconsider,initsdiscretion,grantinganextensioniftherecipientidentifiesstepsandatimelineforcompletingthetool.RecipientsshouldrequestextensionsbyemailingtherequesttoCivilRightsEvaluation@hq.dhs.govpriortoexpirationofthe30-daydeadline.ArticleV-AcknowledgementofFederalFundingfromDHSRecipientsmustacknowledgetheiruseoffederalfundingwhenissuingstatements,pressreleasesrequestsforproposal,bidinvitations,andotherdocumentsdescribingprojectsorprogramsfundedinwholeorinpartwithfederalfunds.ArticleVI-ActivitiesConductedAbroadRecipientsmustensurethatprojectactivitiesperformedoutsidetheUnitedStatesarecoordinatedasnecessarywithappropriategovernmentauthoritiesandthatappropriatelicenses,permits,orapprovalsareobtained.DHS-FEMA-HSGP-SHSP-FY22Page28of44KittitasCounty,E23-116
