Recipientsandsubrecipientsoffederalfinancialassistanceprogramsforinfrastructureareherebynotifiedthatnoneofthefundsprovidedunderthisawardmaybeusedforaprojectforinfrastructureunless:(1)allironandsteetusedintheprojectareproducedintheUnitedStates--thismeansallmanufacturingprocesses,fromtheinitialmeltingstagethroughtheapplicationofcoatings,occurredintheUnitedStates;(2)allmanufacturedproductsusedintheprojectareproducedintheUnitedStates--thismeansthemanufacturedproductwasmanufacturedintheUnitedStates;andthecostofthecomponentsofthemanufacturedproductthatarem.ned,produced.ormanufacturedintheUnitedStatesisgreaterthan55percentofthetotalcostofallcomponentsofthemanufacturedproduct,unlessanotherstandardfordeterminingtheminimumamountofdomesticcontentofthemanufacturedproducthasbeenestablishedunderapplicablelaworregulation;and(3)allconstructionmaterialsaremanufacturedintheUnitedStates--thismeansthatallmanufacturingprocessesfortheconstructionmaterialoccurredintheUnitedStates.TheBuyAmericapreferenceonlyappliestoarticles,materials,andsuppliesthatareconsumedin,incorporatedinto,oraffi×edtoaninfrastructureproiect.Assuch,itdoesnotapplytotools.equipment,andsupplies,suchastemporaryscaffold.ng,broughttotheconstructionsiteandremovedatorbeforethecompletionoftheinfrastructureprojectNordoesaBuyAmericapreferenceapplytoequipmentandfurnishings.suchasmovablechairs,desks,andportablecomputerequipment,thatareusedatorwithinthefinishedinfrastructureproject.butarenotanintegralpartofthestructureorpermanentlyaffixedtotheinfrastructureprojectkVaiversWhennecessary,recipientsmayapplyfor,andtheagencymaygrant,awaiverfromtheserequirements.(a)Whenthefederalagencyhasmadeadeterminationthatoneofthefollowingexceptionsapplies.theawardingofficialmaywaivetheapplicationofthedomesticcontentprocurementpreferenceinanycaseinwhichtheagencydeterminesthat(1)applyingthedomesticcontentprocurementpreferencewouldbeinconsistentwiththepublicinterest;(2)thetypesofiron,steel,manufacturedproducts,orconstructionmaterialsarenotproducedintheUnitedStatesinsufficientandreasonablyavailablequantitiesorofasatisfactoryquality;or(3)theinclusionofiron,steel,manufacturedproducts,orconstructionmaterialsproducedintheUnitedStateswillincreasethecostoftheoverallprojectbymorethan25percent.Arequesttowaivetheapplicationofthedomesticcontentprocurementpreferencemustbeinwriting.TheagencywiIprovideinstructionsontheformat,contents,andsupportingmaterialsrequiredforanywaiverrequest.Waiverrequestsaresubjecttopubliccommentperiodsofnolessthan15daysandmustbereviewedbytheOMBMadeinAmericaOfficeTheremaybeinstanceswhereanawardqualifies,inwholeorinpart,foranexistingwaiverdescribed.ForawardsbytheFederalEmergencyManagementAgency(FEMA),existingwaiversareavailableandthewaiverprocessisdescribedatwerenceinFRAFitiancialAssistanceProcramsforinfrastructure|FEMA.gov.ForawardsbyotherDHScomponents,pleasecontacttheapplicableDHSFAO.ToseewhetheraparticularDHSfederalfinancialassistanceprogramisconsideredaninfrastructureprogramandthusrequiredtoincludeaBuyAmericapreference,pleaseeithercontacttheapplicableOHSFAO,orforFEMAawards,pleaseseeProgramsandDefinitions.BuildAmerceBayAmericaAct|FEMA.gov.ArticleXXXV-SAFECOMRecipientsreceivingfederalfinancialassistanceawardsmadeunderprogramsthatprovideemergencycommunicationequipmentanditsrelatedactivitiesmustcomplywiththeSAFECOMGuidanceforEmergencyCommunicationGrantsincludingprovisionsontechnicalstandardsthatensureandenhanceinteroperablecommunications.ArticleXXXVI-TerroristFinancingRecipientsmustcomplywithE.O.13224andU.S.lawsthatprohibittransactionswith,andtheprovisionsofresourcesandsupportto,individualsandorganizationsassociatedwithterrorismRecipientsarelegallyresponsibletoensurecompliancewiththeOrderandlaws.ArticleXXXVII-TraffickingVictimsProtectionActof2000(TVPA)TraffickinginPersonsDHS-FEMA-EMPG-FY22Page32of39KittitasCounty,E23-184
