ATTACHMENT18-C (6) <br />1.Failure to comply with any of the rules,regulations or provisions referred to herein,orsuchstatues,regulations,executive orders,and HUD guidelines,policies or directives asmaybecomeapplicableatanytime; <br />2.Failure,for any reason,of the Subrecipient to fulfill in a timely and proper manner itsobligationsunderthisAgreement. <br />3.Ineffective or improper use of funds provided under this Agreement;or <br />4.Submission by the Subrecipient to the Local Government of reports that are incorrect orincompleteinanymaterialrespect. <br />In accordance with 2 CFR 200.339,this Agreement may also be terminated by either theLocalGovernmentortheSubrecipient,in whole or in part,by setting forth the reasons forsuchtermination,the effective date,and,in the case of partial termination,the portion tobeterminated.However,if in the case of a partial termination,the Local Governmentdeterminesthattheremainingportionoftheawardwillnotaccomplishthepurposeforwhichtheawardwasmade,the Local Government may terminate the award in its entirety. <br />9.ADMINISTRATIVEREQUIREMENTS <br />A.Financial Management <br />1.Accounting Standards <br />The Subrecipient agrees to comply with 2 CFR 200 and agrees to adhere to theaccountingprinciplesandproceduresrequiredtherein,utilize adequate internalcontrols,and maintain necessary source documentation for all costs incurred. <br />2.Cost Principles <br />The Subrecipient will administer its program in conformance with 2 CFR 200.Theseprincipleswillbeappliedforallcostsincurredwhetherchargedonadirectorindirectbasis. <br />3.Duplication of Costs <br />The Subrecipient certifies that work to be performed under this Agreement does notduplicateanyworktobechargedagainstanyothercontract,subcontract or othersource. <br />B.Documentation and Record Keeping <br />L Records to Be Maintained <br />The Subrecipient will maintain all records required by the Federal regulations specifiedin24CFR570.506 that are pertinent to the activities to be funded under this AgreementandthoserecordsdescribedintheCDBGManagementHandbook.Such records willincludebutnotbelimitedto: <br />a.Records providing a full description of each activity undertaken; <br />b.Records demonstrating that each activity undertaken meets one of the NationalObjectivesoftheCDBGprogram; <br />Revised 1/25/2021ContractPage007 <br />Page 6 of 14 <br />Doc ID:7af681bb0ca653703df74fe4909e206e42be12f0
