ATTACHMENT 18-C (4) <br />7.SPECIAL CONDITIONS- <br />A.Prevent Duplication of Benefit <br />The CARES Act provides that there are adequate procedures in place to prevent anyduplicationofbenefitasrequiredbysection312oftheRobertT.Stafford Disaster ReliefandEmergencyAssistanceAct(42 U.S.C.5155),as amended by section 1210 of theDisasterRecoveryReformActof2018(division D of Public Law 115-254;132 Stat.3442).HUD requires each Grantee (and subrecipient)have procedures to prevent theduplicationofbenefitswhenitprovidesfinancialassistancewithCDBG-CV funds.Federaldisasterlawprohibitstheprovisionoffederalassistanceinexcessofneed.Before paying <br />a cost with federal disaster assistance,the Grantee (and subrecipient)must check to seethattheassistancewillnotcauseaduplicationofbenefits,meaning that the cost has notorwillnotbepaidbyanothersource.Any person or entity (including subrecipients)receiving CDBG-CV assistance must agree to repay assistance that is determined to beduplicative;and to assess whether the use of CDBG-CV funds will duplicate financialassistancealreadyreceivedorislikelytobereceivedbyactingreasonably,Grantees (andsubrecipients)must have a method to evaluate need and the resources available to meetthatneed.CDBG-CV funded activities will prevent,prepare for,and respond to thecoronavirus <br />8.GENERAL CONDITIONS <br />A.General Compliance <br />The Subrecipient agrees to comply with: <br />•The requirements of Title 24 of the Code of Federal regulations,570 (HUD regulationsconcerningCDBG);and <br />•All other applicable Federal,State and Local laws,regulations,and policies,governingthefundsprovidedunderthisAgreement. <br />B.CDSG National Objective <br />The Subrecipient certifies the activities carried out under this Agreement meet a CDBGProgramNationalObjectivedefinedin24CFR570.208. <br />C.Independent Contractor <br />Nothing contained in this Agreement is intended to,or will be construed in any manner,ascreatingorestablishingtherelationshipofemployer/employee between the parties.TheSubrecipientwillatalltimesremainan"independent contractor"with respect to theservicestobeperformedunderthisAgreement.The Local Government will be exemptfrompaymentofallUnemploymentCompensation,FICA,retirement,life and/or medicalinsuranceandWorkers'Compensation Insurance,as the Subrecipient is an independentcontractor. <br />Revised 1/25/2021ContractPage005 <br />Page 4 of 14 <br />Doc ID:7af681bb0ca653703df74fe4909e206e42be12f0
