The roads being considered are 29th Avenue, Mustang Court, <br />Morgan Court, Longhorn Loop and the portions of Roundup Drive, <br />Wrangler Drive and Bridle Way located north of 29th Avenue. <br /> <br />THOSE PRESENT & TESTIFYING: JOHN WOODS said he was a neighbor of <br />Black Horse and there’s been a LUPA filed in court on the entire <br />project. He said if the County authorizes the request and then if <br />the appellant prevails in the appeal, it could all end up changing. <br />He recommended that the Board not make a decision on the matter <br />until the LUPA has been settled. THERE BEING NO OTHERS REQUESTING <br />TO TESTIFY, THE PUBLIC PORTION OF THE HEARING WAS CLOSED. <br /> <br />NEIL CAULKINS, DEPUTY PROSECUTOR, addressed the LUPA case filed and <br />there was no stay put in place, hence the Board is legally free to <br />make a determination, as is the applicant having to do with plat. He <br />said the case has been bogged down with discovery issues and the <br />County has been trying to work with the appellants, but in essence <br />they have not been pushing their case. <br /> <br />RESOLUTION 2023-006 BLACK HORSE AT WHISKEY CREED PUD PUBLIC WORKS <br /> <br />VICE-CHAIRMAN WACHSMITH moved to approve Resolution No. 2023-006, <br />On-System Road Establishment for Roads within the Northern Portion <br />of the Black Horse at Whiskey Creek Planned Unit Development. <br />COMMISSIONER OSIADACZ seconded.
