SECTION4:DEFINITIONS4.1Attachment:AdocumentprovidedbytheSubrecipient(application,budgetplan,etc.)thatisalsomadepadofthisagreementandincorporatedbyreference.SeealsoExhibit.4.2MLE:ThefederallyfundedMarineLawEnforcementProgramadministeredbyWashingtonStateParksandRecreationCommission(WSPRC).ForpurposesofthisagreementMLErepresentstheStateofWashington.IfMLEceasestoexistorisnolongerthestateprogramdesignatedtoadministerthisfederalprogram,thenreferencestoMLEwillbeunderstoodtobetheStateofWashington.4.3Equipment.Equipmentmeanstangiblepersonalpropedyhavingausefullifeofmorethanoneyearandaper-unitacquisitioncostwhichequalsorexceedsthelesserofthecapitalizationlevelestablishedbythenon-Federalentityforfinancialstatementpurposes,or$5,000.004.4Exhibit:AdocumentprovidedbytheMLEProgramthatisalsoapartofthisagreementandincorporatedbyreference.SeealsoAttachment.4.5RBSOfficer:RecreationalBoatingSafetyOfficerisafullycommissionedlawenforcementofficerinWashingtonStateandhastheauthoritytoenforcethelawsofthestateofWashingtonandlocalordinances.TheRBSOfficermusthaveattendedtheWashingtonstateBasicMarineLawEnforcementAcademyoranequivalentrecognizedbyMLE.4.6BoatingSafetyInspection:Afullinspectionforallsafetyequipment,vesselregistrationwhenrequiredandmandatoryboatereducationcompliancewhenrequired.TheresultsoftheinspectionshallbedocumentedthroughWashingtonstatesStatewideElectronicCollisionandTicketOnlineRecords(SECTOR).ThismaybedoneatthetimeoftheinspectionorwhenSECTORisavailabletotheRBSOfficer.4.7LawEnforcementVessel:Avesselusedbyalawenforcementagencyandshallbeequippedwithpropermarkingsshowingittobeanofficiallawenforcementvessel.4.8RecreationalVessel:Definedinfederalregulation50CFR85.11asavesselownedandoperatedprimarilyforpleasure,oravesselleased,rented,orchaderedtoanotherforrecreationaluse.4.9Subrecipient:ANon-Federalentitythatreceivesasubawardfromapass-throughentitytocarryoutpadofafederalprogram;butdoesnotincludeanindividualthatisabeneficiaryofsuchprogram.Inthisagreement,thesubrecipientisthesuccessfulapplicantwithwhomWashingtonMLEawardsaFederalFinancialAssistanceGrant(See2CFR200.93).4.10SubrecipientGrantAgreement:Alsoknownasasubaward.Definedinfederalregulationas"anawardprovidedbyapass-throughentitytoasubrecipientforthesubrecipienttocarryoutpartofafederalawardreceivedbythepass-throughentity.Itdoesnotincludepaymentstoacontractororpaymentstoanindividualthatisabeneficiaryofafederalprogram.Asubawardmaybeprovidedthroughanyformoflegalagreement,includinganagreementthatthepass-throughentityconsidersacontract(See2CFR200.92).4.11Smallagency:Anagencywhichservicesajurisdictionwithapopulationbelow30,000peopleasdeterminedbythelatestU.S.Census.4.12Mediumagency:Anagencywhichservicesajurisdictionwithapopulationof30,000ormoreandbelow100,000peopleasdeterminedbythelatestU.S.Census.MLE123-407SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page2of35
