c)Mustadoptandcomplywithrecord-keepingrequirementsforcontrolledproperty.i)UponLESOrequest,LEAsmustprovideacopyofthegeneralpolicingstandardsandspecificcontrolledpropertystandardsthatwereadopted,toincludeanyrelatedpolicies/procedures.ii)Record-KeepingRequirement-LEAsmustretaincomprehensivetrainingrecords,eitherinthepersonnelfileoftheofficerwhowastrainedorbytheLEAstrainingdivisionorequivalententity,foraperiodofatleastthree(3)years,andmustprovideacopyoftheserecords,uponLESOrequest.7)TRAININGLEAsthatrequestorhaveacquiredcontrolledpropertyviatheLESOProgrammustestablishwrittenpolicies/proceduresforcontrolledpropertyuse,andallpersdnnelwhoareauthorizedtousethecontrolledpropertywillbetrainedonthesepolicies/procedures.LEAsmust:a)Provideannualtrainingongeneralpolicingstandardstopersonnelwhomayusethecontrolledproperty.b)Provideannualtrainingonpropertystandardstopersonnelwhomayusethecontrolledproperty.c)Providecontrolledpropertyoperationalandtechnicaltrainingtopersonnelandensurepersonnelareproficientpriortousingcontrolledproperty.d)Providescenario-basedtrainingtopersonnelthatcombinesconstitutionalandcommunitypolicingprincipleswithcontrolledpropertyspecifictraining.LEApersonnelauthorizingordirectingtheuseofcontrolledpropertyshouldhaveenhancedscenario-basedtrainingtoexamine,deliberate,andreview.thecircumstancesinwhichcontrolledpropertyshouldorshouldnotbeused.8)DOCUMENTATIONREQUIREDFOR"SIGNIFICANTINCIDENTS"LEAsmustcollectandretaintheinformation(describedbelow)whenanylawenforcementactivityinvolvesa"SignificantIncident"whichrequires(orresultsin)theuseofcontrolledpropertyontheLEAsinventory.A"SignificantIncident"isdefinedasanylawenforcementoperationoractionthatinvolves:1)aviolentencounteramongciviliansorbetweenciviliansandthepolice,2)ause-of-forcethatcausesdeathorseriousbodilyinjury,3)ademonstrationorotherpublicexerciseofFirstAmendmentrights,or4)aneventthatdraws,orcouldbereasonablyexpectedtodraw,alargenumberofattendeesorparticipants,suchasthosewhereadvancedplanningisneeded.LEAsmust:a)Collectandretaindocumentationforcontrolledpropertyusedina"SignificantIncident"foraminimumofthree(3)yearsaftertheincidenthasoccurred.TheLEAmustprovidedocumentationtoLESOuponrequest.i)DocumentationshouldalsobemadeavailabletothecommunitytheLEAservesinaccordancewithapplicablepolicies/procedureswithexemptionsmadeconcerningthedisclosureofanysensitiveinformation,b)Nonewreportorformatisrequiredfor"SignificantIncident"reportssolongasinformationiseasilyaccessibleandorganized.Therequiredinformationmayalreadyexistinapolicereport,operationsplan,officerdailylog,incidentreport,after-actionreportordescribedinause-of-forcereport.Ifrequiredinformation(annotatedbelow)iscontainedinapre-existingreports,theLEAmustsimplyensurethatthereportincludesinformationthatcontrolledpropertywasused.Requiredinformationislistedbelow:i)Nameandquantityofcontrolledpropertyused,includingrelevantdetailssuchasmake/model/serialnumberofcontrolledpropertyused.Page70f9
