iii)LEAsthatdonothaveacurrentSPOAddendumonfilebyJanuary1,2023orwhofailtoannuallycertifythatthevehicle(s)useisexclusivelyfordisaster-relatedemergencies;activeshooterscenarios;hostageorothersearchandrescueoperations;oranti-terrorismpreparedness,protection,prevention,response,recovery,orreliefmustreturnvehicle(s)toDLADispositionServices.4)ACQUIRING(ORRETAINING)CONTROLLEDPROPERTYTheStateshall:a)Review,verifyandonlysubmittoLESOforapproval,requestsforcontrolledpropertybyLEAswhohavecurrentSPOandSPOAddendumonfilewiththestate.b)EnsureLEAsreturncontrolledpropertytoDLADispositionServicesiftheDepartmentofJustice(DOJ)determinesoraFederal,State,Tribal,local,orterritorialcourtentersafinaljudgmentfindingthattheLEAhasengagedinapatternorpracticeofcivilrightsviolations.c)Ensurethatpriortorequesting/acquiringanycontrolledproperty,theLEAs:i)Providewrittenorelectronicnotificationtothelocalcommunityofitsintenttorequestcontrolledproperty.ThenotificationmustbetranslatedintoappropriatelanguagestoinformindividualswithlimitedEnglishproficiency.TheLESOProgramwouldrecommendthatLEAsprovideanoticeofintenttorequestcontrolledpropertytothelocalcommunityonorbeforeJanuary1,2023andatthebeginningofeachfiscalyear(Octoberlst)thereafter.Thisnotificationshouldincludeacomprehensivelistofanycontrolledpropertythatmayberequestedthroughouttheyear.Ifthisnoticeofintentdoesnotincludeaspecificcontrolledpropertyitem,suchitemmaynotberequestedintheLESOProgramuntil30-daysafteranupdatednoticeispublished.ii)ProvidewrittenorelectronicnotificationtothecitycouncilorappropriatelocalCivilianGoverningBody(CGB)ofitsintenttorequestcontrolledpropertyandallow"reasonableopportunitytoreview"(normally30-days).TheLESOProgramwouldrecommendthatLEAsprovideanoticeofintenttotheCGBonorbeforeJanuary1,2023andatthebeginningofeachfiscalyear(Octoberlst)thereafter.Thisnotificationshouldincludeacomprehensivelistofanycontrolledpropertythatmayberequestedthroughouttheyear.Ifthisnoticeofintentdoesnotincludeaspecificcontrolledpropertyitem,suchitemmaynotberequestedintheLESOProgramuntil30-daysafteranupdatednoticeispublished.RequestsforcontrolledpropertymustcomportwithallapplicableapprovalrequirementsoftheCGB.(1)TheaboverequirementincludeselectedSheriff'swhoalsoshallnotifytheirCGBorcityorcountygovernmentwithintheirjurisdiction.(2)IncasesofdisagreementbetweenrequestingLEAsandCGB,theGovernorappointedLESOProgramStateCoordinator(SC)willobtainanadvisoryopinionfromtheStatesAttorneyGeneral'sOfficeonwhetherCGBsareauthorizedbystatelawtodenytherequest.iii)CampusLEAsoperatinginInstitutionsofHigherEducation(IHE)-LEAsoperatinginlHEsotherwisereferredtoas"CampusPolice"or"CampusLEAs"mustalsoadheretotherequirementsidentifiedbelow:(1)ObtaintheIHEBoardofGovernors(oranequivalentbody)explicitapprovalfortheacquisitionofcontrolledproperty.SuchapprovalmustbeevidencedintheCampusLEAsrequestsubmittedtotheLESOProgram.SilenceorinactionbytheCampusLEAsBoardofGovernorsdoesnotconstituteevidenceofapproval,andthe"reasonableopportunitytoreview"(normally30-days)standarddoesnotapplytoCampusLEAapplications.Page4of9
