KITTITAS COUNTY <br />Board of County Commissioners <br /> <br />AGENDA STAFF REPORT <br /> <br />AGENDA DATE: October 18, 2022 <br /> <br />ACTION REQUESTED: Request a Public Hearing to Approve and Execute an Ordinance <br />Directing the Adoption of Fees for Certain Superior Court Filings and <br />Adding a New Chapter to Title 4 of the Kittitas County Code. <br /> <br /> <br />BACKGROUND: On September 1, 2022, the Superior Court amended its Local Rules for a civil <br />action, other than an appeal from a court of limited jurisdiction, to be subject to <br />arbitration if the sole relief sought is a money judgment, and if no party asserts <br />a claim in excess of $50,000, exclusive of attorney's fees, interest and costs. <br /> <br />Pursuant to the provisions of RCW 36.18.016(25), the Board of County <br />Commissioners may set a filing fee to be assessed against the party filing a <br />statement of arbitrability not to exceed $250. $220 of this charge shall be <br />used to offset the cost of the civil arbitration program. $30 of each fee <br />collected under this subjection must be used for indigent defense services. <br /> <br />Pursuant to the provisions of RCW 36.18.016(26), the Board of County <br />Commissioners may set a filing fee not to exceed $400 for filing a request <br />with the Kittitas County Superior Court Clerk for a trial de novo of an <br />arbitration award filed pursuant to RCW 7.06.050 and Superior Couret <br />Mandatory Arbitration Rules. <br /> <br />The Superior Court is requesting the Board of County Commissioners set the <br />following fees; <br /> <br />(1) $250 filing fee for the filing of a statement of arbitrability. <br />(2) $400 for filing a request with the Kittitas County Superior Court <br />Clerk for a trial de novo of an arbitration award. <br /> <br />These fees shall be effective as of January 1, 2023. <br /> <br /> <br />INTERACTION: The Prosecutors office has reviewed and signed the proposed <br />Ordinance. <br /> <br />RECOMMENDATION: Approve and Execute an Ordinance Directing the Adoption of a $250 <br />filing fee for the filing of a statement of arbitrability and $400 for <br />filing a request with the County Clerk for a trial de novo of an <br />arbitration award. <br /> <br />HANDLING: Original – Clerk of the Board <br /> Copy – Auditor <br /> Copy – Prosecutor <br /> Copy – Superior Court
