Alder St. <br />Union Gap, WA 98903 <br />DOCUMENT TITLE: Quit Claim Deed — Water Right <br />GRANTOR: Kittitas County, a political subdivision of the State of <br />Washington <br />GRANTEE: Washington State Department of Ecology, State Trust <br />Water Rights Program <br />LEGAL DESCRIPTION: Instream Flow and Mitigation in the Yakima and Columbia <br />Rivers <br />QUIT CLAIM DEED — WATER RIGHT <br />GRANTOR, KITTITAS COUNTY ("Grantor"), for valuable consideration, hereby <br />conveys and quit claims to the WASHINGTON STATE DEPARTMENT OF ECOLOGY, <br />STATE TRUST WATER RIGHTS PROGRAM ("Grantee") all of Grantor's right, title and <br />interest in and to the water right under Certificate No. S4 -85296-J, described as follows: <br />0.88 cubic feet per second, 181.41 acre-feet per year, instream in a primary <br />reach beginning at a point 100 feet south and 550 feet west of the west <br />quarter corner of Section 30, being within the NW'Y4SW'/ of Section 30, T. <br />17 N., R. 19 E.W.M., and continuing down Spring Creek to its confluence <br />with the Yakima River, then down the Yakima River approximately 1000 feet <br />and .61 cubic feet per second, 126.9 acre-feet per year, instream in a <br />secondary reach beginning at approximately River Mile 148 and 1,300 feet <br />east of the SW corner of Section 30, T. 17 N., R. 19 E.W.M., and continuing <br />downstream in the Yakima River to its confluence with the Columbia River. <br />This instream flow and mitigation right was established in Change <br />Authorization CS4-00535sb9 and was historically appurtenant to real <br />property situated in the County of Kittitas, State of Washington. <br />REMAINDER OF THIS PAGE INTENTIONALLY LEFT BLANK.
