Title 45, Sections 160 and 164. or <br />as required by larv. <br />CFR Title 45, Sections 160 and 164 and any applicable Washington stahrtory lar,r'{"RCW") or <br />Adnrinish'ative Code ("WAC") provision (Federal and State stahrtory or regulatory staridards <br />applicable to this addendum are collectively refened to as "liuv") are b,v ivay of relbrencc, an <br />integralplrt of this Addendurn as if incorporated in lull. Business Associate is charged r.vith the <br />knorvledge of and agrees to abide by the temrs and conditiorrs of larv. To thc extent that any <br />applicable pruvision of RCW or WAC provides for or mandates any standard diftbring from <br />those of Fetleral law, the standard rnore restrictive oldisclrrsure shall control subject to federal <br />preernption; this applies throughout this Addendum rvithout regard to any fiurher explicit <br />reference to RCW or WAC provisions. <br />l'his Addendum is effective upon signing of this attachment or the contract to rvhich it is <br />attachsd, whichever is prior in time. <br />r. PURPOSq <br />The Covered Entity needs to make available nnd/or disclose to the Business Associate ceftain <br />PHI for manergernent, administration, and legal responsibilities during the normal course of <br />business between tlre palties as referenced in the contract or other agreenrent to r,r'hich this <br />document is attached antl incorporated by refbrence. This document is intendecl to det-urc and <br />incorporate but not lirnit the obligations of the Business Associate lviLh regnrd to its use and <br />protection of that PHI. <br />II. RESPONS.IBILITIES OF BUSINBSS ASSOCIATE <br />The Business Associate hereby agrees to do the tbllolving: <br />A. Use and D_is*o-Sure: Use and/or disclose PHi only as permitted or required by this <br />Addcndum, Health lnsurance Ponabiliry and Accountabilrty Act (HIPAA), and the <br />llealth Infonnation Technology for Economic and Clinical Health Act (Division A, Title <br />XIll of the American Recovery and Reinveshnent Act of 2009, Pub. Lalv I I l-5, 2009 <br />HR l) ("rllTECFl").The Business Associate shall use and disclose PHI only if sLrch use <br />or disclosure, respectively, is in compliance with each applicable requirement of 45 CFIt <br />is164.504(e) or other law.
