SECTION4:DEFINITIONS4.1Attachment:AdocumentprovidedbytheSubrecipient(application,budgetplan,etc.)thatisalsomadepaitofthisagreementandincorporatedbyreference.SeealsoExhibit.4.2MLE:ThefederallyfundedMarineLawEnforcementProgramadministeredbyWashingtonStateParksandRecreationCommission(WSPRC).ForpurposesofthisagreementMLErepresentstheStateofWashington.IfMLEceasestoexistorisnolongerthestateprogramdesignatedtoadministerthisfederalprogram,thenreferencestoMLEwillbeunderstoodtobetheStateofWashington.4.3Equipment.Equipmentmeanstangiblepersonalpropertyhavingausefullifeofmorethanoneyearandaper-unitacquisitioncostwhichequalsorexceedsthelesserofthecapitalizationlevelestablishedbythenon-Federalentityforfinancialstatementpurposes,or$5,000.4.4Exhibit:AdocumentprovidedbytheMLEProgramthatisalsoapartofthisagreementandincorporatedbyreference.SeealsoAttachment.4.5RBSOfficer:RecreationalBoatingSafetyOfficerisafullycommissionedlawenforcementofficerinWashingtonStateandhastheauthoritytoenforcethelawsofthestateofWashingtonandlocalordinances.TheRBSOfficermusthaveattendedtheWashingtonstateBasicMarineLawEnforcementAcademyoranequivalentrecognizedbyMLE.4.6BoatingSafetyInspection:Afullinspectionforallsafetyequipment,vesselregistrationwhenrequiredandmandatoryboatereducationcompliancewhenrequired.TheresultsoftheinspectionshallbedocumentedthroughWashingtonstatesStatewideElectronicCollisionandTicketOnlineRecords(SECTOR).ThismaybedoneatthetimeoftheinspectionorwhenSECTORisavailabletotheRBSOfficer.4.7LawEnforcementVessel:Avesselusedbyalawenforcementagencyandshallbeequippedwithpropermarkingsshowingittobeanofficiallawenforcementvessel.4.8RecreationalVessel:Definedinfederalregulation50CFR85.11asavesselownedandoperatedprimarilyforpleasure;oravesselleased,rented,orcharteredtoanotherforrecreationaluse.4.9Subrecipient:ANon-Federalentitythatreceivesasubawardfromapass-throughentitytocarryoutpartofafederalprogram;butdoesnotincludeanindividualthatisabeneficiaryofsuchprogram.Inthisagreement,thesubrecipientisthesuccessfulapplicantwithwhomWashingtonMLEawardsaFederalFinancialAssistanœGrant(See2CFR200.93).4.10SubrecipientGrantAgreement:Alsoknownasasubaward.Definedinfederalregulationas"anawardprovidedbyapass-throughentitytoasubrecipientforthesubrecipienttocarryoutpartofafederalawardreceivedbythepass-throughentity.Itdoesnotincludepaymentstoacontractororpaymentstoanindividualthatisabeneficiaryofafederalprogram.Asubawardmaybeprovidedthroughanyformoflegalagreement,includinganagreementthatthepass-throughentityconsidersacontract(See2CFR200.92).MLE123-122SubrecipientAgreement-BoatingProgram(FFAGrantAward)Page2of64
