MAY 31, 2022 <br /> <br />Board members present: Chairman Laura Osiadacz; Vice-Chairman Cory <br />Wright; and Commissioner Brett Wachsmith. <br /> <br />Others: Julie Kjorsvik, Clerk of the Board; Angela Bugni, Rule 9 <br />Intern; James Canterbury, Security Officer; Neil Caulkins, Deputy <br />Prosecutor; Clay Myers, Sheriff; Dan Carlson, CDS Director; and Toni <br />Berkshire, Code Enforcement Officer. <br /> <br />SPECIAL MEETING EXECUTIVE SESSION COMMISSIONERS <br /> <br />At 2:31p.m. Chairman Osiadacz opened a Special Meeting and announced <br />the Board would recess into an Executive Session until 2:46 p.m. <br />with James Canterbury, Security Officer; Neil Caulkins, Deputy <br />Prosecutor; Clay Myers, Sheriff; Angela Bugni, Rule 9 Intern; Dan <br />Carlson, CDS Director; and Toni Berkshire, Code Enforcement Officer, <br />regarding RCW 42.30.110(1)(i)(i) to discuss with legal counsel <br />representing the agency matters relating to agency enforcement <br />actions, or to discuss with legal counsel representing the agency <br />litigation to which the agency the governing body, or a member <br />acting in an official capacity is, or is likely to become, a party, <br />when public knowledge regarding the discussion is likely to result <br />in an adverse legal or financial consequence to the agency. This <br />subsection (1)(i) does not permit a governing body to hold an <br />executive session solely because an attorney representing the agency <br />is present. For purposes of this subsection (1)(i), “potential <br />litigation” means matters protected by RPC 1.6 or RCW 5.60.060(2)(a) <br />concerning: (i) Litigation that has been specifically threatened to <br />which the agency, the governing body or a member acting in an <br />official capacity is, or is likely to become, a party. Action was <br />anticipated. <br /> <br />At 2:46 p.m. the Board reconvened out of Executive Session. No <br />action taken. <br /> <br />At 2:46 p.m. Chairman Osiadacz announced the Board would recess back <br />into an Executive Session until 2:51 p.m. with James Canterbury, <br />Security Officer; Neil Caulkins, Deputy Prosecutor; Clay Myers, <br />Sheriff; Angela Bugni, Rule 9 Intern; Dan Carlson, CDS Director; and <br />Toni Berkshire, Code Enforcement Officer, regarding RCW <br />42.30.110(1)(i)(i) to discuss with legal counsel representing the <br />agency matters relating to agency enforcement actions, or to discuss <br />with legal counsel representing the agency litigation to which the <br />agency the governing body, or a member acting in an official
