Dept. of Public Works <br />Page 2 <br />Requirements of RCW 36.87.040 Director/Engineer Report: <br />1. Whether County road right of way should be vacated or abandoned. <br />2. Whether road is in use or has been in use. <br />3. The condition of the road. <br />4. Whether it will be advisable to preserve it for the county road system in the future. <br />5. Whether the public will benefit by the vacation. <br />6. A determination by appraisal of the fair market value of the area sought to be vacated. <br />7. The classification of the road area according to the type of expenditures made <br />S. Whether the proposed area to be vacated contains utilities. <br />9. All other matters which will be of interest to the Board including an itemized list of costs <br />and expenses incurred in the examination, report, appraisal and all proceedings pertaining <br />to such petition to vacate and abandon. <br />Required Report Elements Pursuant to KCC 12.22.040 (Mirror RCW 36.87.040): <br />1. Holiday Avenue is 0.110 miles in length, beginning at the intersection of Boat Ramp <br />Road and serves one parcel on the north side and two parcels on the south side of the <br />roadway. The road does not have an outlet and there is not a turnaround on public right- <br />of-way. There are two additional parcels at the end of the road right-of-way. The roadway <br />is within right-of-way dedicated to the public through the plat process. Vacation or <br />abandonment of this roadway segment is appropriate. <br />2. Holiday Avenue has been in use since 1970. The roadway is 20 -ft in width, with parking <br />restricted for the length of the road by ordinance 1997-09. <br />3. The road surfacing is a surface treatment chip seal in good condition. <br />4. The roadway ends at private parcels. Public Works does not anticipate this segment of <br />roadway or right-of-way to be needed for the County Road system. The proposed <br />vacation allows unification of separate lots for the requestors and the added property will <br />add to the tax parcel calculation for the requestors providing additional property tax <br />revenue for the County. <br />5. The public is benefited by the vacation as an increase in property tax revenue results from <br />the vacation action. There would also be a reduction in maintenance cost by Public <br />Works. As there is a proposal for a public swim area in the vicinity, it is anticipated that <br />the vacation will reduce the need for parking enforcement along this segment of roadway. <br />6. An appraisal was not needed since compensation of the vacated land will not be required <br />from the neighboring landowners. <br />7. Maintenance work of the road has been performed within the right-of-way in the past. <br />This has consisted of surface treatment installation and other regular maintenance work. <br />There have been no capital expenditures on the rights-of-way by the County. <br />8. Public Works records include a permit from 1970 for a water and sewer line to be <br />installed across Holiday Avenue to serve property to the north. <br />9. The right-of-way has been dedicated public on recorded plats. This enables the County to <br />provide adjoining properties easements prior to vacation.
