<br />E' The prospective contractor agrees by submitting this contract that, should the proposed covered transaction beentered into, it shall not knowingly enter into any lower tier covered transaction *itt u person who is Jebaned,suspended, declared ineligible, or voluntarily excluded from participation in this covlred transaction, unlessauthorized by DOH.
<br />F' The prospective contractor further agrees by submitting this contract that it will include the clause titledCertification Regarding Debarment, Suspension, Ineligibility and voluntary Exclusion -- Lower Tier coveredTransaction, provided by HHS, without modification, in all lower tier.ou.."d transactions and in all solicitationsfor lower tier covered transactions.
<br />G' A participant in a covered transaction may rely upon a certification of a prospective participant in a lower tiercovered transaction that it is not debaned, suspended, ineligible, or .rrotrntu.ily excluded from the coveredtransaction, unless it knows that the certification ii erroneous. A participant may decide the method and frequencyby which it determines the eligibility.of its principals. Each participant nruy, but is not required to, check theNonprocurement List (of excluded parties).
<br />H' Nothing contained in the foregoing shall be construed to require establishment of a system of records in order torender in good faith the certification required by this clause. ihe knowledge and information of a participant is notrequired to exceed that which is normally possessed by a prudent person irithe ordinary course of business dealings.
<br />I' Except for transactions authorized under paragraph F. of these instructions, if a participant in a covered transactionknowingly enters into a lower tier covered tianiaction with a person who is suspended, debarred, inelilible, orvoluntarily excluded from participation in this transaction, in addition to other rernedies available to the FederalGovemment, DoH may terminate this transaction for cause or default.
<br />7. CERTIFICATION REGARDING DEBARMENT, SUSPENSION, AND OTHER RESPONSIBILITYMATTERS - PRIMARY COVERED TRANSACTIONSA' The contractor certifies to the best of its knowledge and belief, that it and its principals:
<br />1) Are not presently debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excludedfrom covered transactions by any Federai department or agency;
<br />2) Have not within a three{ear period preceding this contract been convicted of or had a civil judgment renderedagainst them for commission of fraud or a criminal offense in connection with obtaining, utL*"ptintto obtain,or performing a public (Federal, State or local) transaction or contract under a public tiansaction; iiolation ofFederal or State antitrust statutes or commission of embezzlement, theft, forgery, bribery, faisification ordestruction of records, making false statements, or receiving stolen property;
<br />3) Are not presently indicted for or otherw-ise criminally or civilly charged by a govemmental entity (Federal,
<br />State or local) with commission of any of the offenses enumeratld in plagraph A.z.of this certification; and
<br />4\ Have not within a three-year period,preceding this contract had one or more public hansactions (Federal, Stateor local) terminated for cause or default.
<br />B' Where the prospective contractor is unable.to certifi to any of the statements in this certification, such prospectivecontractor shall attach an explanation to this contract.
