4.43.2 Contractor represents and warrants that it will comply with all applicable local, State, <br />and federal licensing, accreditation and registration requirements and standards <br />necessary in the performance of the Services. <br />4.43.3 EXECUTIVE ORDER 18-03 - WORKERS', RtcHTS (MANDATORY tNDtVtDUAL <br />ARBITRATION). Contractor represents and warrants, as previously certified in <br />Contractor's bid submission, that Contractor does NOT require its employees, as a <br />condition of employment, to sign or agree to mandatory individual arbitration <br />clauses or class or collective action waivers. Contractor further represents and <br />warrants that, during the term of this Contract, Contractor shall not, as a condition of <br />employment, require its employees to sign or agree to mandatory individual <br />arbitration clauses or class or collective action waivers. <br />4.43.4 Any written commitment by Contractor within the scope of this Contract will be <br />binding upon Contractor. Failure of Contractor to fulfill such a commitment may <br />constitute breach and will render Contractor liable for damages under the terms of <br />this Contract. For purposes of this section, a commitment by Contractor includes: (i) <br />Prices, discounts, and options committed to remain in force over a specified period <br />of time; and (ii) any warranty or representation made by Contractor to HCA or <br />contained in any Contractor publications, or descriptions of services in written or <br />other communication medium, used to influence HCA to enter into this Contract. <br />Washington State <br />Health Care Authority <br />Description of Services <br />HCA Contract #K5885 <br />28
