BOTwERS Ftffii-D KIT"TI"["AS CO{J hITY AI RPORT' <br />Comprehensive general liability insurance coverage in amounts of not less than <br />$1,000,000.00 per occurrence /$2,000,000.00 aggregate <br />Combined Single Limit for bodily injury and property damage covering LESSEE's <br />occupancy of and activities pertaining to the leased premises, <br />Commercial auto liability insurance with a $1,000,000.00 combined single limit, <br />Worker's Comp. insurance, Stop-Gap employer's liability insurance covering <br />$1,000,000.00 each incident, and $5,000,000.00 in umbrella coverage. <br />The certificate of insurance is due at the LEASE commencement and must be <br />maintained throughout the LEASE term. <br />LESSEE specifically agrees that insurance limits shall be reviewed at least every <br />five (5) years and that LESSOR may make reasonable adjustments to the required <br />limits. <br />Not less than 30 days written notice, or other such time period as may be <br />reasonably acceptable to LESSOR, must be supplied to LESSOR in the event of <br />cancellation, material change to the policy or non-renewal of any or all policies. <br />Without limiting the foregoing, a certificate shall be issued by carrier(s) with a <br />minimum A.M. BEST rating of A-Vll which are admitted in the State of Washington <br />or other such carriers as shall be acceptable to Board. <br />During the Term, LESSEE, at LESSEE's expense, will be solely responsible for <br />insuring any and all personal property that is not part of the Premises that is stored, <br />or othenrvise kept in or on the Premises by LESSEE, whether said personal <br />property is owned by LESSEE or any other third party, and on all tenant <br />improvements and betterments LESSEE incorporates into the Premises. <br />9.2 WAIVER OF SUBROGATION RIGHTS <br />LESSEE and LESSOR each waive any and all rights of recovery against the other, <br />or against the agents, independent contractors, employees, customers, suppliers, <br />representatives, and invitees of each other, for loss of or damage to such waiving <br />party, property, or property of others under its or their control, where such loss or <br />damage is insured against under any insurance policy in force at the time of such <br />loss or damage. Further, LESSOR and LESSEE will cause their respective insurers <br />to waive said insurers' respective rights of subrogation/recovery against the other <br />party pursuant to this provision and to provide one another, at their respective <br />requests, with written notice of said waivers. <br />9.3 INDEMNIFICATION BY LESSEE <br />i)LESSEE IN LESSOR INI <br />PAGE 8
