<br />Professional Services Agreement <br />Page 19 <br />2. Client Rights. The Contractor shall: <br /> <br />a. Ensure that a statement of Client Rights are posted in compliance with Section <br />388-850-050 WAC; and <br /> <br />b. Ensure that Client rights and client health and safety are protected in <br />compliance with Section 388-850-040 WAC and DDA Policy 5.06: Client <br />Rights. <br /> <br />c. Ensure protection from abuse: mandatory reporting per DDA Policy 5.13. <br /> <br />3. Credentials and Minimum Requirements. <br /> <br />Contractor shall ensure that Contractor meets the following requirements: <br /> <br />a. Fiscally Responsible: The Contractor must demonstrate the ability to safeguard <br />public funds including maintaining books, records, documents and other <br />materials relevant to the provision of goods and services. <br /> <br />b. Sufficient Policies and Procedures for Establishment and Maintenance of <br />adequate internal control systems: The County will maintain written policy <br />procedural manuals for information systems, personnel, and accou nting/finance <br />in sufficient detail such that operations can continue should staffing change or <br />absences occur. <br /> <br /> <br />c. Background/Criminal History Check: A background/criminal history clearance is <br />required every three years for all employees (including DD program County <br />staff), subcontractors, and/or volunteers who may have unsupervised access to <br />vulnerable DSHS Clients, in accordance with RCW 43.43.830-845, RCW <br />74.15.030, and Chapter 388 WAC. If the entity reviewing the application elects <br />to hire or retain an individual after receiving notice that the applicant has a <br />conviction for an offense that would disqualify the applicant from having <br />unsupervised access to vulnerable adults as defined in Chapter 74.34 RCW, <br />then DDA shall deny payment for any subsequent services rendered by the <br />disqualified individual provider. The DSHS Background Check Central Unit <br />(BCCU) must be utilized to obtain background clearance. <br /> <br />d. Qualified Service Providers: The Contractor assures that all service providers <br />meet qualifications as outlined in the DDA Policy 6.13, Program Provider <br />Qualifications. <br /> <br /> <br />e. Home and Community Based Waiver Services Assignment of Medicaid Billing
