<br />7-1 Hardware Limlted Warranty. Axon warrants that Axon-manufactured Devices are free fromdefects in workmanship and materials for 1 year from the date of Agency's receipt, except SignaiSidearm, which Axon warrants for 30 months from the date of Agenly's ieceipt. Axon wananti ltsAxon-manufactured accessories for 9O-days trom the date of Ageniy's receipt. Used conductedenergy weapon ("C!W,) cartridges are deemed to have operated pr6perly. Extended wananties
<br />run from the expiration of the 1-year hardware wananty through the-extendld wananty term. Non-Axon manufactured Devices are not covered by Axon's w-ranty. Agency should'contact themanufacturer for support of non-Axon manufactured Devices.
<br />7.2 Claims. lf Axon receives a valid wananty claim for an Axon manufactured Device during the
<br />lvarranty term, Axon's sole responsibility is to repair or replace the Device with the same o-r like
<br />Device, at Axon's option. A replacement Axon Device will bb new or like new. Axon willwarrant thereplacement Axon Device for the longer of (a) the remaining warranty of the original Axon Device
<br />or (b) 9Odays from the date of repair or replacement.
<br />lf Agency exchanges a device or parl, the replacement item becomes Agency's property, and thereplaced item becomes Axon's property.,Before delivering a Axon Device-for slruice, nglicy rnusiupload Axon Device data to Axon Evidence or download it and retain a copy. Rlon is notresponsible for any loss of sofh,vare, data, or other information contained in storagl media or anypart of the Axon Device sent to Axon for service.
<br />7.3 Spare Axon Devices. Forqualified purchases, Axon may provide Agency a predetermined number
<br />of spare Axon Devices as detailed in the Quote ("Spare Axon Deviles"i. spare Axon Devices areintended to replace broken or non-functioning units while Agency su'umits the broken or non-functioning units, through Axon's wananty retuh process. Axo-n wili repair or replace the unit witha replacement Axon Device. Title and risk of loss for all Spare Axon D6vices shail pass to ngencyin accordance with shippiLg teqs under Section 5. Axon assumes no liability or obligation in th6event Agency does not utilize Spare Axon Devices for lhe intended purpose.
<br />7.4 Limitatlons. Axon's wananty excludes damage related to: (a) failure to follow Axon Device useinstructions; (b) Axon Devices used with equipment not manuiactured or recommended by Axon;(c) abuse, misuse, or intentional damage to A.,ron Device; (d) force majeure; (e) Axon Oeviceirepaired or modified by persons other than Axon without Axon's written permiision; or (f) Axon
<br />Devices with a defaced or removed serial number.7-4.1 To the extent permltted by law, the above warranties and remedies are exctusive.Axon disclaims all other warrantles, remedles, and conditlons, whether oral, wrltten,statutory, or lmplied. lf statutory or lmplied warranties cannot be lawfully distlaimeO,

<br />by the provisions in this Agreement.7.4-2 Axon's.cumulative liability to any Party for-any loss or damage resulting from anyclaim, demand, or actlon arising out of or relating to any A<on bevlce or S1rvice wiilnot exceed_ the purchase price paid to Aron for the Axbn Device, or if for Services,the amolfnt paid for such Servlces over the 12 months preceding the claim. NeitheiParty will be llable for dlrect, special, indirect, incidental, punifiv=e or conseguential
<br />damages, however caused, whether for breach of warranty or contract, negligence,strict liability, tort or any other legal theory.
<br />StatFment of Work. Certain Axon Devices and Services, including Axon Interview Room, Axon ChannelServices, and Axon Fleet, may require a Statement of Work tfrit Oetaits Axon's Service deliverables("SOllY,). ln the event Axon provides an SOW to Agency, Axon is only responsible to perform Seruicesdescribed in the SOW. Additionalservices are out oflcop-e. The Partieimusi document icope changes in
<br />a written and signed change order. Changes may require an equitable adjustment in fees or schedule. TheSOW is incorporated into this Agreement by reference
