<br /> <br />BOWERS FIELD KITTITAS COUNTY AIRPORT <br /> <br /> <br /> <br />LESSEE INITIAL__________ LESSOR INIT IAL__________ <br /> <br /> PAGE 16 <br />21.3 MEDIATION. <br /> <br />In the event of a dispute between the LESSEE and the LESSOR with respect to <br />the interpretation, implementation, or performance of any obligation under this <br />Lease, with the exception of non-payment of rent, the LESSEE and the LESSOR <br />will attempt to resolve the dispute through a mediation process before taking action <br />under Section 21.1(a)-(b) or 21.2 (a)-(b) above. The mediator for any such <br />mediation must be mutually agreed upon and jointly appointed by the LESSEE and <br />the LESSOR, with the mediator’s cost to be shared equally by the two parties. The <br />mediation will be held in Ellensburg, Washington and conducted as soon as <br />reasonably possible after mediation is compelled with attention given to the time - <br />sensitive nature of the dispute. In the event the parties are unable to agree upon <br />a mediator, a mediator will be appointed by the Presiding Judge for the Superior <br />Court of Kittitas County. <br /> <br />22. AIRPORT AND AIRCRAFT OPERATIONS. <br /> <br />It is understood and agreed that the LESSEE's use of said premises and leased area <br />shall not in any manner interfere or restrict the use of aircraft landings, take-offs, or <br />storage of aircraft. LESSEE shall comply with all rules and regulations of the FAA, <br />Washington State DOT Aeronautics Division, and the Kittitas County Code. <br /> <br />23. FIREARMS AND FIREWORKS. <br /> <br />Discharging of firearms or fireworks will not be permitted on or from said premises or <br />leased area. <br /> <br />24. NOTICES. <br /> <br />Any notice given by one party to the other in connection with this agreement shall be <br />in writing and shall be sent by certified or registered mail, return receipt requested as <br />follows: <br /> If to LESSOR, addressed to: Kittitas County Airport <br /> c/o County Auditor <br /> 205 W. 5th Ave. Suite 105 <br /> Ellensburg, WA 98926 <br /> <br /> If to LESSEE, addressed to: Ray Rhodes <br /> Western Investment Network <br /> 505 N. Pearl St <br /> Ellensburg, Wa 98926 <br /> <br /> With Copy to: U-Haul. ? need an address or email <br /> <br />All notices under this Lease must be in writing and will be deemed given to the <br />receiving party when (a) personally delivered to the Airport Manager for Kittitas
