A.1 4.3 4.2 Attachment B Washington State Mil itary Oepartment GENERAL TERMS AND CONDITIONS Department of Homeland Security (OHS| Federal Emergency Management Agency (FEMA) Grants DEFINITIONS As.used throughout this Agreement, the terms will have the same meaning as defined in 2 CFR 200 Subpart A (which is incorporated herein by reference), except as otherwise set torth below:a. 'Agreement" means this Grant Agreement.b' "Department" means the Washington State Military Department, as a state agency, any division, section, office, unil or other enti$ of the Department, or any of the officers or other officia'is lawfully representing that Department, The Department is a recipient of a federal award direcfly trom i federal awarding agency and is the pass-through entity making a subaward to a Subiecipient under this Agreement. c. "lnvestment" means.the grant application submitted by the Subrecipient describing the project(s) forwhichfederalfunding is sought and provided underihisthisAgreiment. Such gEnt aipricatii; is hereby incorporated into this Agreement by reference. d. "Monitoting Activities" means all administrative, financial, or other review activities that are conducted to ensure compliance with all state and federal laws, rules, regulations, authorities, and policies. e. "Stakeholders Preparedness Report (SPR)" The SPR is an annual three-step self-assessment of a communi$'s capability levels based on the capability targets identified in the TH|RA.f. "Subrecipienf'when capitalized is primarily used throughout this Agreement in reference to the non-federal entity identified on the Face Sheet of this Agreement that has received a subaward from the Departmenl. However, the definition of "subrecipient" is the same as in 2 CFR 200.1 for all other purposes. g- "Threat and Hazard ldentification and Risk Assessment (THIRA)" The THIRA is a three.step risk assessment. The THIRA helps communities understand their risks and determine the level df capability they need in order to address lhose risks. The outputs from this process lay the foundation for determining a community's capability gaps during the SPR process. ADVANCE PAYMENTS EROHIBITED The Department shall qale no payments in advance or in anticipation of goods or services to be provided underlhis Agreement, Subrecipient shall not invoice the Department in advance of delpery and invoicing of such goods or services. AMENDIVI EIITS AN D MO Dt Ft CATTONS The Subrecipient or the Department may request, in writing, an amendment or modification of thisAgreement. However, such amendment or modification shall nol be binding, take effect or be incorporated herein until made in writing and signed by the authorized representatiies of the Department and..the Subrecipient. No other understandings or agreements, written'or oral, shall be binding on theparties. The Agree_ment performance period shall only be extended by (1) written notification of DHS/FEMA approval of the Award performance period, fgllolved up with a mritu'aity agreed written amendment, or (Z) written notification from the Department to the Subrecipient to provide iOCitionattime for compleiion'o? the Subrecipient's project(s). 3A Th.e Subrecipient must comply with the ADA, which provides comprehensive civil rights protection to indiMduals with disabilities in the areas of employment, public accommodationsJ staie and localgovernment services, and telecommunication.
