A.1 <br />4.3 <br />4.2 <br />Attachment B <br />Washington State Mil itary Oepartment <br />GENERAL TERMS AND CONDITIONS <br />Department of Homeland Security (OHS| <br />Federal Emergency Management Agency (FEMA) <br />Grants <br />DEFINITIONS <br />As.used throughout this Agreement, the terms will have the same meaning as defined in 2 CFR 200 <br />Subpart A (which is incorporated herein by reference), except as otherwise set torth below:a. 'Agreement" means this Grant Agreement.b' "Department" means the Washington State Military Department, as a state agency, any division, <br />section, office, unil or other enti$ of the Department, or any of the officers or other officia'is lawfully <br />representing that Department, The Department is a recipient of a federal award direcfly trom i <br />federal awarding agency and is the pass-through entity making a subaward to a Subiecipient <br />under this Agreement. <br />c. "lnvestment" means.the grant application submitted by the Subrecipient describing the project(s) <br />forwhichfederalfunding is sought and provided underihisthisAgreiment. Such gEnt aipricatii; <br />is hereby incorporated into this Agreement by reference. <br />d. "Monitoting Activities" means all administrative, financial, or other review activities that are <br />conducted to ensure compliance with all state and federal laws, rules, regulations, authorities, <br />and policies. <br />e. "Stakeholders Preparedness Report (SPR)" The SPR is an annual three-step self-assessment <br />of a communi$'s capability levels based on the capability targets identified in the TH|RA.f. "Subrecipienf'when capitalized is primarily used throughout this Agreement in reference to the <br />non-federal entity identified on the Face Sheet of this Agreement that has received a subaward <br />from the Departmenl. However, the definition of "subrecipient" is the same as in 2 CFR 200.1 for <br />all other purposes. <br />g- "Threat and Hazard ldentification and Risk Assessment (THIRA)" The THIRA is a three.step <br />risk assessment. The THIRA helps communities understand their risks and determine the level df <br />capability they need in order to address lhose risks. The outputs from this process lay the <br />foundation for determining a community's capability gaps during the SPR process. <br />ADVANCE PAYMENTS EROHIBITED <br />The Department shall qale no payments in advance or in anticipation of goods or services to be provided <br />underlhis Agreement, Subrecipient shall not invoice the Department in advance of delpery and invoicing <br />of such goods or services. <br />AMENDIVI EIITS AN D MO Dt Ft CATTONS <br />The Subrecipient or the Department may request, in writing, an amendment or modification of thisAgreement. However, such amendment or modification shall nol be binding, take effect or be <br />incorporated herein until made in writing and signed by the authorized representatiies of the Department <br />and..the Subrecipient. No other understandings or agreements, written'or oral, shall be binding on theparties. <br />The Agree_ment performance period shall only be extended by (1) written notification of DHS/FEMA <br />approval of the Award performance period, fgllolved up with a mritu'aity agreed written amendment, or (Z) <br />written notification from the Department to the Subrecipient to provide iOCitionattime for compleiion'o? <br />the Subrecipient's project(s). <br />3A <br />Th.e Subrecipient must comply with the ADA, which provides comprehensive civil rights protection to <br />indiMduals with disabilities in the areas of employment, public accommodationsJ staie and localgovernment services, and telecommunication. <br />A.4 <br />DHS-FEMA.EMPG-FY21 Page 11 of35 Kittitas Coung Sheriffs Office EM, E22-217
