Contractor hereby wiives all righd of recdurse,including. any right to which another may be subrogated, against t<iititas County toipersonal injury, induding death, and propertydamage. Contractor's insurance policies <br />required above shall be prim{ry insunance and shall be non-contributing with any <br />other insurance maintained by Kittitas County. <br />The Contractor shall assume full responsibility for atl loss or damage frorn any cause <br />whatsoever.to any tools, Contracto/s employee-owned tools, machinery, equipment, or <br />mobcr vehicles owned or rented by the Confractor, orthe Contractofs agents, buppliilrs <br />or contractors as wellas to anytemporary structures, scaffoldingand protective fences. <br />The Contractor shall have sole responsibility for ensuring the insurance coverage and <br />limits required are obtained by subcontractors- <br />NOTE: No contract shall form until and unless a copy of lhe Certificate ofInsurance with Endorsements/Exclusions, properly completed and in the amountreguired, is attached hereto. <br />Failure of the Contractorto fullycomplywith the above insurance requirements du 6ng <br />the term of the Agreement shall be considered a material breach of contract and cauJe <br />for immediale termination of the Agreementat the County'sdiscretion. Altematively,the <br />County may procure and maintain, at the Contractor's soLe expense, insurance to the <br />extent deemed proper upto the amountof the required coverage(s).
