CITY OF CI.E ELUM <br />t2. <br />(e) Other Insurnnce provisions <br />Kittitas county self-insures losses incurred by Lessee that are <br />determined not within,coverage (occurrence iate or exclusion) ofthe pool's Joint Self-InsuranceMemorandum of Liability Coverage Document <br />(f) Verification of Covorage <br />Kittitas county shall issue a "Letter of RiskPool Liability coverage" to Lessor regarding Lessee,s liabilitycoverage forthis Lease Agreement. A Pool Memorandum orLiabTtity c"u.*g;-OAtj will also be issuedto Lessor, identifuing the Lease Agreement and naming Lessor as certificate Holder. <br />($ Waiver of Subrogation <br />Lessee and Lessor hereby release and discharge each oflrer from all claims, losses and liabilities arisingfrom or caused by any hazardcovsred by property insuranoe on or in connection with the premises or said <br />i"X.ll#; <br />This release shall apply only'to the-extent that such craim, Ioss or ii"uility is covered by <br />(h) Notice of Cancellation <br />lhe Les9e9 shall provide the Lessor with written notice of any policy cancellation within two businessdays of their receipt of such notice. <br />(i) Failure to Mainfain Insurance <br />Failure on the part of the Lessee to maintain the insurance as required shall constitutc a material b*ach oflease, upon which the Lessor may, after giving five business iuyr' notice to the Lessee to correct thebreach, terminate the Leaso o., ui itr aiscretioi, prorrr. ;;;;;* such insurance and pay any and allpremiums in connection therewith, with any sums so expended to be repaid to the Lessor on demand. <br />fi) Lessor Full Availability of Lessee Limits <br />If the Lessee maintains higher insurance limits than the minimums shown above, the Lessor shall beinsured for the full available limits of commercial General and Excess or umbrella liability maintainedby ttre Lessee, inespective ofwhether such limits maintain;l;y ttre.tesse. <br />"r, gr*t.rihan those requiredby this Lease or whether any certificate of insurance fumi*rej to th.
