3.1 3.2 3.3 4.t 4.2 4.3 4.4 5.1 Article 3: Permitted Uses and Disclosures bv Business Associate Specific Purposes. Business associate may only use or disclose protected health information as required or permitted by law. Leeal Resoonsibilities. Except as otherwise limited in this Agreement, Business Associate may use Protected Health lnformation for the proper management and administration of the business associate or to carry out the legal responsibilities of the business associate. Reporting Law Violations. Business Associate may use Protected Health lnformation to report violations of law to appropriate Federal and State authorities, consistent with 5 164.502(jX1). Article 4: Oblieations of Covered Entitv Notice of Privaq, Practices. Covered Entity shall notify Business Associate of any limitation(s) in its notice of privacy practices of Covered Entity in accordance with 45 CFR 5 154.520, to the extent that such limitation may affect Business Associate's use or disclosure of Protected Health lnformation. lndividual Permission. Covered Entity shall notify Business Associate of any changes in, or revocation of, permission by lndividual to use or disclose Protected Health lnformation, to the extent that such changes may affect Business Associate's use or disclosure of Protected Health lnformation. Restrictions. Covered Entity shall notify Business Associate of any restriction to the use or disclosure of Protected Health lnformation that Covered Entity has agreed to in accordance with 45 CFR 5 764.522 and 42 CFR Part 2 , to the extent that such restriction may affect Business Associate's use or disclosure of Protected Health lnformation. Prohibited Requests. Covered Entity shall not request Business Associate to use or disclose Protected Health lnformation in any manner that would not be permissible under the Privacy Rule or Confidentiality Rule if done by Covered Entity. Article 5: Term and Termination Term. The Term of this BA Agreement shall be effective as of the date signed, and shall terminate when all of the Protected Health lnformation provided by Covered Entity to Business Associate, or created or received by Business Associate on behalf of Covered Entity, is destroyed or returned to Covered Entity, or, if it is infeasible to return or destroy Protected Health lnformation, protections are extended to such information, in accordance with the termination provisions in this Section.
